C. Consideration to Cancel the August 25, 2015 City Council Meeting Over the past several years, the City Council has cancelled its second meeting in August as a summer break. Accordingly, the City Council will consider action to cancel the August 25, 2015 City Council meeting. The next regular City Council meeting is scheduled for September 8, 2015. Recommendation: That the City Council cancel the August 25, 2015, City Council meeting due to a lack of quorum. D. Garvey Avenue Sewer Relief Line Project — Award of Contract As part of the July 2010 tax increment bond issuance by the City's former Redevelopment Agency, funding was included to increase capacity in the sanitary sewer system along Garvey Avenue. Based on information gathered as a part of the Sewer System Management Plan (SSMP), which was completed in 2009, the sewer capacity along Garvey Avenue needs to be expanded to accommodate current and future land uses along this corridor. As a part of this project, a sewer relief line will be built along Bartlett Avenue, between Garvey Avenue and Klingerman Street, which will divert sewer flow into an existing Los Angeles County Sanitation District sewer trunk line on Klingerman Street. On July 8, 2015, the City Clerk received and publically read seven (7) bids for the construction of this project. Sully - Miller Contracting Co. provided the lowest responsive bid and it is recommended that they be awarded the contract for this project. In addition to the Base Bid, which is the described sewer construction, it is recommended that Alternate Bid Item No. 1 also be awarded. Alternate Bid Item No. 1 is the complete rehabilitation of Bartlett Avenue with new pavement as the construction activity will have significant impacts to the existing street surface. Recommendation: It is recommended that the City Council: 1. Approve the plans and specifications for the Garvey Avenue Sewer Relief Line Project; and 2. Authorize the City Manager to enter into a contract with Sully - Miller Contracting Co. in the amount of $1,011,000 and authorize an amount of $150,000.00 (approximately 15 %) as a contingency to cover the cost of any unforeseen construction expenses. Ordinance No. 951 — Second Reading: Approving Municipal Code Amendment (MCA) 15.02 and Amending Chapters 17.04 and 17.72 of Title 17 of the City of Rosemead Municipal Code Relating to Regulations for Nonconforming Uses, Structures, Lots, and Parking Facilities On July 14, 2015, the City Council introduced Ordinance No. 951, approving MCA 15 -02 and amending Chapters 17.04 and 17.72 of Title 17 of the City of Rosemead Municipal Code relating to regulations for Nonconforming Uses, Structures, Lots, and Parking Facilities. Ordinance No. 951 is now before Council at the required second reading for adoption. As introduced at its first reading, Ordinance No. 951 contains standards for development applications requesting the addition of new structures on R -1 and R -2 lots where nonconforming residential structures exist. The Ordinance requires that such requests include a signed written consent on a form created by the City from all property owners of land abutting the subject property, as well as a notarized sworn declaration from the project applicant stating that the declaration is made under penalty and perjury that all written consents are true and accurate. Lastly, the project may be granted only after a public hearing before the Planning Commission. Recommendation: It is recommended that City Council adopt Ordinance No. 951 at its second reading, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING MUNICIPAL CODE AMENDMENT 15.02, AMENDING CHAPTERS 17.04 AND 17.72 OF TITLE 17 OF THE CITY OF ROSEMEAD MUNICIPAL CODE RELATING TO REGULATIONS FOR NONCONFORMING USES, STRUCTURES, LOTS, AND PARKING FACILITIES F. Adoption of the Updated 2015 Congestion Management Program and 2015 Local Development Report The Congestion Management Program (CMP) is a state mandated program that helps address the impact of urban congestion in local communities. The CMP requires that cities in Los Angeles County file annually a Local Development Report (LDR) indicating the City's actions taken to reduce traffic congestion in the region. Additionally, on odd numbered years, the City must conduct traffic counts and calculated levels of service for identified arterial intersections. The City has conducted the necessary traffic counts at the intersection of Rosemead Boulevard and Valley Boulevard, as required by the CMP. In order to meet its requirements, the City must adopt a resolution finding the City of Rosemead in compliance with the CMP for Los Angeles County and also submit a Local Development Report. Recommendation: It is recommended that the City Council: 1. Adopt Resolution No. 2015 46 finding that the City is in conformance with the Congestion Management Program (CMP) for the County of Los Angeles; entitled: Page 4 of 6 ROSEMEAD CITY COUNCIL AND THE SUCCESSOR AGENCY OF THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION JOINT MEETING AGENDA July 28. 2015 A RESOLUTION OF THE CITY OF ROSEMEAD, CALIFORNIA, FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089 2. Adopt the 2015 Local Development Report and authorize staff to submit the CMP Local Development Report to the Los Angeles County Metropolitan Authority. 5. MATTERS FROM CITY MANAGER & STAFF A. Municipal Code Amendment 15 -03 — An Ordinance Amending the Building and Construction Code and Zoning Code to Comply with Newly Established State Regulations for Solar Energy Systems Municipal Code Amendment 15 -03 is a City initiated amendment that proposes to amend the Building and Construction Ordinance and Zoning Ordinance to comply with newly established State regulations for the streamlining of permit processes for small residential rooftop solar systems. Recommendation: It is recommended that the City Council introduce for First Reading, by title only, Ordinance No. 954, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING MUNICIPAL CODE AMENDMENT 15.03, ADDING CHAPTER 15.10 — SOLAR ENERGY SYSTEMS TO TITLE 15 (BUILDING AND CONSTRUCTION) AND AMENDING SUBSECTION 17.28.020(B)(3)(B)(5) OF TITLE 17 (ZONING) OF THE CITY OF ROSEMEAD MUNICIPAL CODE RELATED TO STATE REGULATIONS FOR SOLAR ENERGY SYSTEMS 6.
