Second Reading of Ordinance No. 951: Approving Municipal Code Amendment (MCA) 15 -02 Relating to Regulations for Nonconforming Uses, Structures, Lots, and Parking Facilities On July 14, 2015, the City Council introduced Ordinance No. 951, approving MCA 15 -02 and amending Chapters 17.04 and 17.72 of Title 17 of the City of Rosemead Municipal Code relating to regulations for Nonconforming Uses, Structures, Lots, and Parking Facilities. Ordinance No. 951 is now before Council at the required second reading for adoption. As introduced at its first reading, Ordinance No. 951 contains standards for development applications requesting the addition of new structures on R -1 and R -2 lots where nonconforming residential structures exist. The Ordinance requires that such requests include a signed written consent on a form created by the City from all property owners of land abutting the subject property, as well as a notarized sworn declaration from the project applicant stating that the declaration is made under penalty and perjury that all written consents are true and accurate. Lastly, the project may be granted only after a public hearing before the Planning Commission. Recommendation: Adopt Ordinance No. 954 at its second reading, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING MUNICIPAL CODE AMENDMENT 15- 03, ADDING CHAPTER 15.10 — SOLAR ENERGY SYSTEMS TO TITLE 15 (BUILDING AND CONSTRUCTIN) AND AMENDING SUBSECTION 17.28.020(8)(3)(5) OF TITLE 17 (ZONING) OF THE CITY OF ROSEMEAD MUNICIPAL CODE RELATED TO STATE REGULATIONS FOR SOLAR ENERGY SYSTEMS E. Professional Services Agreement with LASER, LLC for Interim Public Works Director Services The City Council will consider approval of a professional services agreement with the engineering firm of LA Solutions for Engineering Solutions (LASER) LLC for interim Public Works Director Services. The individual designated to perform these temporary contractual services is the Principal of LASER, LLC, Anthony M. La. Recommendation: That the City Council approve a professional services agreement with LASER, LLC F. Fiscal Year 2015 -16 Road Resurfacing Projects Award of Contract — Design Engineering As part of the Fiscal Year 2015 -16 Capital Improvement Program, the City Council approved two street rehabilitation projects entitled "Annual Residential Resurfacing" and 'Temple City Blvd Resurfacing: 10 Freeway to Guess St. ". The Temple City Boulevard project will include street rehabilitation and resurfacing from 1 -10 to Guess Street. The Annual Residential Resurfacing will consist of street rehabilitation and resurfacing on Steele Street from Ellis Lane to Rosemead Boulevard, and Ivar Avenue from Mission Drive to Marshall Avenue. The scope of work for these projects includes the grind and replacement of asphalt, repair and replacement of sidewalk, curb and gutter, new roadway striping, and related work. This award of contract is for design services for these projects, which includes surveying, pavement analysis, and development of street improvement plans. These projects are funded through Gas Tax and Prop C. funds in the amount of $975,000.00. Recommendation: It is recommended that the City Council authorize the City Manager to enter into a contract with CEJ Engineers, Inc. for design engineering services for the "Annual Residential Resurfacing" and 'Temple City Blvd Resurfacing /1oFwy to Guess St." improvement projects in the amount of $82,420.00 and authorize a contingency of $12,300 (approximately 15 %) to cover the cost of any unforeseen elements in the design process. Page 4 of 8 ROSEMEAD CITY COUNCIL AND THE SUCCESSOR AGENCY OF THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION JOINT MEETING AGENDA Auaust 11, 2015 Highway Safety Improvement Project — Garvey Avenue Award of Contract During Fiscal Year 2010 -2011, the City applied for and was awarded funding through the Highway Safety Improvement Program, Cycle 5, which is a Federal grant program for traffic and pedestrian safety improvements. The awarded funds are for the construction of pedestrian and traffic safety enhancements along Garvey Avenue, including upgrades to several traffic signal systems including the addition of pedestrian countdown heads, upgrading existing signal heads to larger sized LEDs, the addition of video detection systems for traffic phasing, and emergency vehicle preemption systems. In May 2015, staff advertised the project for bid and all bids received were in excess of the engineer's estimate at the time of $350,000. On May 26, 2015, the City Council rejected all bids, and directed staff to review and modify the scope of work, and to conduct another public bid process for this project. The revised project was advertised for bid, with an engineer's estimate of $450,000, and on August 5, 2015, three bids were received. PTM General Engineering Services, Inc. submitted the lowest bid of $479,079 and staff recommends that a contract be awarded to this firm for the Highway Safety Improvement Project, Garvey Avenue. The approved budget for this project is $489,500, however, based on design expense, staff time, and construction costs the necessary budget is approximately $606,000. Staff is requesting an appropriation of an additional $117,000 from the Street Lighting District in order to complete this project. Recommendation: that the City Council: 1. Authorize the City Manager to enter into a contract with PTM General Engineering Services, Inc. for Highway Safety Improvement Project — Garvey Avenue in the amount of $479,079 and authorize a contingency amount of $72,000 (Approximately 15 %) to cover the cost of any unforeseen construction expenses. 2. Approve Resolution 2015 -50 appropriating $117,000 in additional Street Lighting District Funds for the completion of this project. S. MATTERS FROM CITY MANAGER & STAFF A. Review and Approval of Rosemead Park Skate Plaza Design At its regular meeting on April 28, 2015, the City Council approved a contract with Spohn Ranch Skateparks to design a skate plaza at Rosemead Park in the area directly east of the aquatic center. As prescribed in the agreement with Spohn Ranch, public meetings were held at the Rosemead Community Recreation Center on June 17 and July 22, 2015 to solicit input from the community on the design of the skate plaza. The design of a 10,000 square feet skate plaza is being presented to City Council for review and approval. Upon approval, construction documents will be developed and the project readied for construction. Skate plaza construction will, then, be publicly bid or contracted directly through a cooperative purchasing program at City Council's discretion. Page 5 of 8 ROSEMEAD CITY COUNCIL AND THE SUCCESSOR AGENCY OF THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION JOINT MEErING AGENDA Recommendation: That the City Council: 1. approve the proposed design of the Rosemead Skate Plaza, and 2. authorize the City Manager to execute an Interlocal Contract through the Helping Governments Across the Country Buy (HGACBuy) cooperative purchasing program, in an amount not to exceed $475,000, for construction of the skate plaza project. B. Paratransit Contract Discussion and Award In 2008, the City Council awarded a five -year contract for paratransit services to Southland Transit ( "Southland "). The contract was subsequently extended for an additional two years through June 30, 2015. Southland has since provided services on a month -to -month extension through October 31, 2015, or until the new contract is awarded. On May 13, 2015, consistent with City Council direction, the City issued the Request for Proposals (RFPs) for paratransit services, and later received a total of four proposals. Technical review and financial analysis of the proposals are provided in the Paratransit Services section. Complementing the RFPs, on April 14, 2015, the City authorized the purchase of five gasoline buses, which have since been manufactured and are now pending delivery. On July 14, 2015, the City Council requested additional information, including: alternative fuel buses, cost and performance comparisons, surrounding cities' practices, etc. A summary of such information is provided in the Vehicle Purchase section. Recommendation: That the City Council take the following actions: 1. Award a contract for paratransit services, and; 2. Provide direction regarding the pending delivery of the buses. C. Dissemination of New or Revised Administrative Policies and Departmental Policy Documents to Members of the City Council The City Council will consider adoption of a Resolution directing the City Manager to forward new or revised administrative policies or departmental policy documents to members of the City Council for informational purposes. Recommendation: City Council direction is requested. 6.
