CC - Item 4B - Minutes of June 23, 2015 MINUTES OF THE CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION JOINT MEETING JUNE 23, 2015 The joint meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission was called to order by Mayor/Chair Clark at 6:00 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Clark, Mayor Pro Tem Armenta, Council Member Alarcon ABSENT: Council Members Low and Ly STAFF PRESENT: City Manager Allred, City Attorney Richman, and City Clerk Molleda 1. CLOSED SESSION City Attorney Richman announced that the City Council would recess to closed session to conference with legal counsel on the following items A. Conference with Legal Counsel Public Employee Appointment pursuant to Government Code Section 54957 Title: City Clerk B. Conference with Legal Counsel — Existing Litigation Update City of Rosemead v. Beneficial Patient Group, Inc. et al.; Los Angeles County Superior Court Case EC 063589 Pursuant to Government Code Section 65956.9 (d)(1) Regular Business 7:00 p.m. • CALL TO ORDER Mayor Clark/Chair called the meeting to order at 7:00 p.m., at which time City Attorney Richman announced that no reportable action was taken in closed session. • PLEDGE OF ALLEGIANCE— Mayor Clark led the flag salute. • INVOCATION — Mayor Pro Tern Armenta presented the invocation • ROLL CALL: Mayor/Chair Clark, Mayor Pro Tem/Vice-Chair Armenta, Council Member/ Board Member Alarcon. Council Member/Board Member Ly was present via teleconference ABSENT: Council Member/Board Member Low Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of June 23,2015 Puget of ITEM NO. 4.B STAFF PRESENT: City Manager Allred, City Attorney Richman, Assistant City Manager/Acting Public Works Director Hawkesworth, Community Development Director Ramirez, Director of Parks and Recreation Montgomery-Scott, Public Works Manager Sullivan, and City Clerk Molleda. 2. PUBLIC COMMENTS FROM THE AUDIENCE None. 3. PRESENTATIONS • Proclamation for Battalion Chief Miguel Garcia Mayor Clark presented Battalion Chief Miguel Garcia with a proclamation congratulating him on his promotion to Battalion Chief for the Los Angeles County Fire Department in appreciation for his dedicated service to the safety and wellbeing of the Rosemead Community. Battalion Chief Garcia thanked the City Council for the recognition and looked forward to continuing to serve the citizens of Los Angeles County.• of Rosemead Queen The 2015 Rosemead Queen Krista Rios, was introduced to the City Council. She was an incoming senior at San Gabriel High School with a grade point average of 3.4. Ms. Rios created the Matador Multicultural Dance Club, was a member of the Correo Dance Team, served two years as Class Council Treasurer and is a Member of Culturo Latina, Interract and MOMA clubs. She was on the Varsity Track Team and Cross Country Team and a member of the Yearbook Staff. Ms. Rios was presented with the Miss Rosemead crown, a sash, and a bouquet of flowers from the City Council, Ms. Rios, thanked her family, her teachers and mentor. She thanked the City Council for the honor 4. PUBLIC HEARING A. Municipal Code Amendment 15-02 - Amending Chapters 17.04 and 17.72 of Title 17 of the City of Rosemead Municipal Code Relating to Regulations for Nonconforming Uses, Structures, Lots, and Parking Facilities Recommendation: That the City Council: (1) Approve the Negative Declaration of Environmental Impacts finding that the project will not have a significant adverse effect on the environment; and (2) Move to INTRODUCE FIRST READING, by title only Ordinance No. 951, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPROVING MUNICIPAL CODE AMENDMENT 15.02, AMENDING CHAPTERS 17.04 AND 17.72 OF TITLE 17 OF THE CITY OF ROSEMEAD MUNICIPAL CODE RELATING TO REGULATIONS FOR NONCONFORMING USES, STRUCTURES, LOTS, AND PARKING FACILITIES Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of June 23,2015 Page 2 of 7 City Planner Sheri Bermejo provided the City Council with a brief report indicating the ordinance would amend Title 17 of the Municipal Code to modify several regulations for nonconforming uses, structures, lots, and parking facilities. On June 9'"the City Council conducted a public hearing for the amendment and proposed Ordinance No. 951. Upon hearing written and oral testimony the City Council continued the public hearing to this meeting and directed staff to bring back a revised ordinance to allow the addition of new separate conforming residential structures on R-1 Single Family and R-2 Light Multiple residential lots that include legal nonconforming structures, subject to the approval of a minor exception application by the Planning Commission. The City Council also added a standard that would require notarized, written signatures of property owners of the lots abutting the subject project site. Mayor Clark opened the public hearing. There being no one wishing to speak, Mayor Clark closed the public hearing. ACTION: Mayor Clark moved, and seconded by Council Member Alarcon to approve the Negative Declaration of Environmental Impacts finding that the project will not have a significant adverse effect on the environment. The motion carried by the following roll call vote: AYES: Council Members Alarcon and Ly, Mayor Pro Tern Armenta, and Mayor Clark. ABSENT: Council Member Low. The City Attorney read the title or Ordinance No. 951 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CALIFORNIA, APPROVING MUNICIPAL CODE AMENDMENT 15-02, AMENDING CHAPTERS 17.04 AND 17.72 OF TITLE 17 OF THE CITY OF ROSEMEAD MUNICIPAL CODE RELATING TO REGULATIONS FOR NONCONFORMING USES, STRUCTURES, LOTS, AND PARKING FACILITIES. ACTION: Moved by Council Member Alarcon, and seconded by Mayor Pro Tem Armenta to approve Ordinance No. 951 on first reading. Claims and Demands • Resolution No. 2015—39 Recommendation: tot approve Resolution No. 2015—39, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF$1,509,616.15 NUMBERED 89001 THROUGH 89160 INCLUSIVELY • Resolution No. 2015— 13 Recommendation: to approve Resolution No. 2015— 13, entitled: A RESOLUTION OF THE CITY OF ROSEMEAD AS THE SUCCESSOR AGENCY OF THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $1,166.50 NUMBERED 10131 Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of 23, 2015 Page 3 of 7 B. Authorization to Attend the International City Management Association Conference—September 27th—30th—Seattle, Washington Recommendation: That the City Council authorize the attendance by the Assistant City Manager at City expense. C. Crossing Guard Services—Amendment to Agreement with All City Management Services, Inc., and Annual Cost Sharing Agreements with School Districts Recommendation: That the City Council authorize the City Manager to: (1) Execute and Amendment to an Agreement with All City Management Services, Inc. through June 30, 2017; and (2) Execute cost sharing agreements with the Rosemead School District and the Garvey School District in funding the crossing guard services for the 2015-16 fiscal year. D. School Resource Officer Program Funding Recommendation: That the City Council approve the agreement with the El Monte Union High School District for assistance in funding the SRO position. E. Installation of Additional Red Curb at Hellman Avenue and Isabel Avenue Recommendation: That the City Council approve the Traffic Commission's recommendation to extend existing red curbing an additional 45 feet (approximately) on the southwest corner of Hellman Avenue at Isabel Avenge. F. Review of Traffic Calming Improvements at Hellman Avenue Recommendation: That the City Council approve the Traffic Commission's recommendation of improved signage and striping along Hellman Avenue. ACTION: Moved by Council Member Alarcon, and seconded by Mayor Pro Tem Armenta to approve Consent Calendar Items A through F. The motion carried by the following roll call vote: AYES: Council Members Alarcon and Ly, Mayor Pro Tem Armenta, and Mayor Clark. ABSENT: Council Member Low. 6. MATTERS FROM CITY MANAGER & STAFF • A. Proposed Agreement with San Gabriel Valley Humane Society for Animal Shelter and Care Services Recommendation: That the City Council approve a two-year agreement with the San Gabriel Valley Humane Society effective July 1, 2015; and authorize the termination of the existing agreement with Los Angeles County Department of Animal Care and Control. City Manager Allred advised the City Council that staff was recommending a contract with the San Gabriel Valley Humane Society to enhance the efficiency and productivity of the city employees that perform animal control duties as it would provide improved accessibility for Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of June 23, 2015 Page 4 of 7 residents who currently have to drive to Baldwin Park. He noted that the City has contracted with Los Angeles County Animal Control for a number of years and the costs continue to increase. He advised he just received a letter stating the costs would be increasing next year and that Los Angeles County has contracted with an outside auditing company to undertake a comprehensive study of the appropriateness of the current billing rate methodology to determine if all applicable costs were being captured. He indicated that before the City Council was the agreement negotiated with San Gabriel Valley Humane Society. Michael Reyes, Public Safety Supervisor advised the City Council that staff believed a contract with San Gabriel Valley Humane Society would lower the costs and increase productivity explaining to Council the length of time it took staff to process an impound with Los Angeles County in Baldwin Park. Cindy Ridnev, San Gabriel Valley Humane Society Board of Directors advised the City Council that the Humane Society has been serving the Cities of.SariGabriel and Temple City for over 90 years and she would be happy to answer any questions. In response to a question by Council Member Alarcon regarding who to call if a dead animal was found, Mr. Reyes advised that during the hours of 7:00 a.m. to 8:00 pm. Mondays through Saturdays, calls would be made to Public Safety and after hour calls would be made to the Temple City Sheriffs Station where calls would be referred to the Humane Society who has an on-call officer to provide service. Council Member Ly remarked on his attendance at the San Gabriel City Council meeting last week in which the City Council discussed how pleasedth&'City was with the services of the San Gabriel Valley Humane Society.. Brian Lewin thanked the City Council for addressing this issue and expressed his pleasure. He also thanked the animal control officer, when a neighbor decided to get a rooster, and the animal control officer acted quickly and the rooster was gone. Mayor Pro Tem Armenta asked Ms. Ridney whether the Humane Society had the means to provide care for wild life such as a baby bird. Ms. Ridley responded that it would depend on the type of bird and the type of wild life. ACTION: Moved by Mayor Pro Tern Armenta, and seconded by Council Member Alarcon to approve the agreement with the San Gabriel Valley Humane Society. The motion carried by the following roll call vote: AYES: Council Members Alarcon and Ly, Mayor Pro Tem.Armenta, and Mayor Clark. ABSENT: Council Member Low. B. Proposal for Rosemead Farmer's Market Recommendation: That the City Council Authorize the City Manager to execute an agreement with Green Leaf Events, Inc. to host a weekly Farmer's Market in the Civic Center Plaza on Mondays, 4:00—8:00 p.m. for a trial period of six months at no cost to the City for event operations. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of June 23, 2015 Page 5 of 7 Parks and Recreation Director David Montgomery-Scott advised the City Council that the City Council and residents have expressed an interest in having a Farmer's Market in Rosemead for a long time. Recently Greenleaf Events submitted a request to host a certified Farmer's Market in the newly renovated Civic Center Plaza. The event would feature food vendors and food trucks, children's play area, commercial and artisan booths in addition to certified produce providers. The proposal is for a turnkey operation in which Greenleaf would be responsible for all event logistics and to maintain the Plaza in a safe and clean condition at all times and to maintain all insurance requirements. Greenleaf proposed to operate the market on Mondays from 4:00 p.m. to 8:00 p.m. rain or shine, and would) begin setting up at 3:00 p.m. and remain until 9:00 pm. for cleanup. He advised that Mondays was selected because there were no competing markets in the area on Mondays and it worked logistically for the City because the Library was closed on Mondays. The proposal was for a trial period of six month; however, Greenleaf was interested in making this a year round activity if it did well. Mayor Pro Tern Armenta discussed the way in which this came about and the role she played in setting up the meetings with Greenleaf and City staff: She expressed her excitement that the City would finally get a farmer's market after many failed attempts in the past. She also mentioned the Beautification Committee's idea of holding a sidewalk chalk contest. Council Member Ly thanked Mayor Pro Tem Armenta for her efforts and expressed his excitement of adding this component to the Civic Center which has already become a gathering place for people to walk and otherwise enjoy:in the evenings. Brian Lewin echoed Mayor Pro Tem Armenta, and looked forward to the Beautification Committee's idea of the sidewalk chalk art competition His only concern was the parking lot closure during Planning Commission meetings held on Mondays, twice a month. Parks and Recreation Director Montgomery-Scott advised ingress and egress would be maintained throughout the night. Larry Truiillo with Greenleaf Events looked forward to working with the City of Rosemead noting the years of experience they had In Organizing events. He mentioned that both he and Mr. Diaz were Rosemead natives. Hue c n addressed Council stating that if the event was going to be successful it should be held on Wednesdays because everyone he knew shopped at the Alhambra Farmers Market on Sundays. ACTION: Mayor Pro Tem Armenta moved, and seconded by Council Member Alarcon to Authorize the City Manager to execute an agreement with Greenleaf Events, Inc. to host a weekly.Farmer's Market in the Civic Center Plaza on Mondays, 4:00—8:00 p.m. for a trial period of six months. The motion carried by the following roll call vote: AYES: Council Members Alarcon and Ly, Mayor Pro Tem Armenta, and Mayor Clark. ABSENT: Council Member Low. 7. MATTERS FROM CITY COUNCIL Council Member Ly thanked City Clerk Molleda for her years of service to the City of Rosemead and wished her well in her new job. He also reminded the City Council that he Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of June 23,2015 Page 6 of 7 would not be present for the next six months because he would be on military duty. He expected to return the first meeting in December. Mayor Pro Tern Armenta advised that she attended the NALEO Conference this past weekend and three presidential candidates spoke at the conference. She advised on some of the workshops she attended at the conference and the value gained from her attendance. Mayor Pro Tem Armenta also thanked City Clerk Molleda for her service mentioning it would be difficult not to have her here and commending her on all the services she provided for the City Council. Council Member Alarcon thanked City Clerk Molleda for the fabulous job she performed and for her professionalism. Mayor Clark thanked Ms. Molleda for her years of service and professionalism. She enjoyed working with her and wished her well Mayor Clark also attended the National League of Cities Environmental Steering Committee meeting in Salt Lake City and one of the topi{s of discussion was adaptation for extreme weather events which was something that was being seen throughout the country. Mayor Clark announced the upcoming events: the 4th of July parade at 10:00 a.m., 5K run at 7:00 a.m., the carnival during the day and opening ceremony at Rosemead Park at 5:00 p.m. She also mentioned the Relay for Life Luminaria ceremony on Thursday, June 25th at Zapopan Park. Mayor Pro Tem Armenta also mentioned the Beautification Committee Cleanup Project, Saturday, June 27'" at Savannah Cemetery from 9:00 a.m. to 12:00 Noon. 8. ADJOURNMENT There being no further business to come before the City Council, Mayor Clark adjourned the meeting in memory of the victims of the tragedy that took place in Charleston, South Carolina, at 7:50 p.m. The nextreguta.City Council meeting was scheduled to take place on July 14, 2015, at 7:00 pm. in the Rosemead City Hall Council Chamber.
