PUBLIC HEARINGS A. Municipal Code Amendment 15-08 — A City Initiated Ordinance Amending Rosemead Municipal Code Title 13 "Public Services," Chapter 13.08 "Water Efficient Landscapes" and Associated Guidelines in Accordance with Governor Brown's Drought Executive Order(B-29-15) In response to Governor Brown's declared state of emergency due to severe drought conditions and his Executive Order (EO B-29-15) to update the State's Model Water Efficient Landscape Ordinance, cities throughout California are required to update their landscape ordinances. The City of Rosemead proposes to amend Chapter 13.08 of the Rosemead Municipal Code "Water Efficient Landscaping Regulations" and related "Water Efficient Landscape Guidelines"to comply with State law. Recommendation: That the City Council take the following actions: 1. Conduct the noticed public hearing and receive public comment; and 2. Introduce for First Reading, by title only, Ordinance No.960 "An Ordinance of the Rosemead City Council Amending Chapter 13-08 of the Rosemead Municipal Code Amending the Water Efficient Landscape Standards Guidelines to be Consistent with State Law." B. Municipal Code Amendment 15-07 —An Ordinance Amending Rosemead Municipal Code, Title 17 "Zoning," Chapter 17.40 "Medical Marijuana Dispensaries" to prohibit Medical Marijuana Cultivation Facilities and Medical Marijuana Deliveries in all Zones of the City On February 11, 2014, the City Council adopted Ordinance No. 935 which added provisions to the Rosemead Zoning Code (Title 17) that prohibit medical marijuana dispensaries city-wide. On September 11, 2015, the California Legislature passed three bills that will create a broad State regulatory and licensing system governing the cultivation, testing, and. distribution of medical marijuana, as well as physician recommendations for medical marijuana. Governor Brown signed the three bills (Assembly Bills 243 and 266, and Senate Bill 643) on October 9, 2015. The new legislation preserves local control over marijuana facilities and land uses, including the authority to prohibit dispensaries and other medical marijuana businesses completely. In the City's experience, medical marijuana dispensaries and cultivation sites pose significant threats to public health and safety. Municipal Code Amendment 15-07 (MCA 15-07) proposes an ordinance to prohibit both medical marijuana cultivation facilities and the delivery of medical marijuana within the.City. Recommendation: That the City Council take the following Actions: 1. Conduct the noticed public hearing and receive public comment; and 2. Introduce for First Reading, by title only, Ordinance No. 959 — "An Ordinance of the City Council of the City of Rosemead, California Amending Title 17 "Zoning" of the City's Municipal Code by Amending Chapter 17.40 to Prohibit Medical Marijuana Cultivation Facilities and Medical Marijuana Deliveries. Ordinance No. 955— Second Reading: Municipal Code Amendment 15-05—Adoption of Amended Fireworks Ordinance On September 22, 2015, the City Council introduced Ordinance No. 955, amending (in its entirety) Chapter 8.28 of the City's Health and Safety Code (Title 8 of the Rosemead Municipal Code) entitled Fireworks. This Ordinance was reintroduced at the Council meetings of October 27, 2015, November 10, 2015, and November 24, 2015 due to substantial changes made at each of these respective meetings. Ordinance No. 955 is now before Council at the required second reading for adoption. Recommendation: That the City Council Adopt Ordinance No. 955 at its second reading. MATTERS FROM CITY MANAGER&STAFF A. Rosemead Farmers Market for 2016 The City Council will consider an extension of the agreement with Green Leaf Events, Inc. to continue the Rosemead Farmers Market in 2016. The proposal is to move the Farmers Market to Thursday evenings between 5 p.m. to 9 p.m. in the Civic Center Plaza. Also, the Farmers Market would be conducted only during the Spring through the Fall months of the ' year from April through October. Recommendation: that the City Council direct the City Manager to execute an agreement with Green Leaf, Inc. to operate the Rosemead Farmers Market in the Civic Center Plaza in 2016 on Thursday evenings between 5 p.m. to 9 p.m. during the months of April through October. 7.
