In addition, the applicant is proposing to remove and replace an existing freestanding sign along the southeast corner of the lot. The intent of this modification is to reimage the existing U-Haul to match the new, more contemporary corporate façade designs and signage. A Design Review is required for all improvements requiring a building permit or visible changes in form, texture, color, exterior façade or landscaping. The subject site is located at 3527 Ivar Avenue (APN: 5390-018-033) in a C-3/D-O (Medium Commercial with Design Overlay) zone. Environmental Determination Section 15301 of the California Environmental Quality Act (CEQA) guidelines exempts projects consisting of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities. mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Accordingly, Modification 15-01 is classified as a Class 1 Categorical Exemption pursuant to Section 15301 of CEQA guidelines. Staff Recommendation It is recommended that the Planning Commission ADOPT Resolution No. 16-09 with findings (Exhibit "A"), and APPROVE Modification 15-01, subject to the 21 conditions outlined in Attachment "A" attached hereto. Property History and Description The subject property is located on the west side of Ivar Avenue, between Glendon Way and Interstate 10 (1-10) Freeway. According to the Los Angeles County Assessor's Office, the site consists of one (1) parcel, totaling approximately 43,410 square feet of lot area. According to Planning and Building Division records, a Design Review (Design f 3 Planning Commission Meeting June 20,2016 Page 2 of 15 Review 86-18) and a Conditional Use Permit (Conditional Use Permit 86-354) were approved for a 52,354 square foot mini-storage facilty, consisting of two (2) buildings with 459 rental spaces and a two-bedroom dwelling for the live-in manager (Exhibit "C"). The site is surrounded by the following land uses and zones: North General Plan Designation: Commercial Zoning: C-3/D-0 (Medium Commercial with Design Pverlay) Land Use: Commercial South General Plan Designation: Public Facilities and Ivar Avenue Zoning: P (Parking) and Ivar Avenue Land Use: Rubio Wash and Public Street East General Plan Designation: Commercial Zoning: C-3/D-0 (Medium Commercial with Design Overlay) and P-D (Planned Development) Land Use: Parking Lot West General Plan Designation: Commercial and Public Facilities Zoning: C-3/D-0 (Medium Commercial with Design Overlay)and P (Parking) Land Use: Vacant Lot and Rubio Wash Administrative Analysis The applicant is proposing to renovate both buildings to U-Haul's new, more contemporary corporate façade designs and signage. According to the applicant, eight (8) out of the eleven (11) U-Haul's that he manages have undergone a façade renovation and sign modification. According to Rosemead Municipal Code Section 17.28.020(A)(1), in the Design Overlay zone, Design Review procedures shall be followed for all improvements requiring a building permit or visible changes in form, texture, color, exterior façade, or landscaping. The proposed project would not add new floor area to the existing building, affect the existing floor plan, or change the existing site layout. Elevations As illustrated in Exhibit "B", the project includes re-painting the buildings in white and shades of tan colors and incorporating a diamond shaped paint pattern on a majority of the walls (Sher-Cryl Brand, "August Moon" and "Yellow Stone"). The applicant will also paint all exterior storage roll-up doors orange ("Sierra Sunset"). All existing awnings will be removed, replaced, or refurbished with new dark tan or green colored canvas awnings. In addition, the applicant is proposing to add decorative elements to the façade of Building A by installing faux metal storage doors and a powder coated steel wave on the on the east, north, and south elevations. The faux metal storage doors and steel wave will be painted orange ('`Sierra Sunset"). Planning Commission Meeting June 20,2016 Page 4 of 15 Signage As part of the re-imaging, the applicant is requesting to remove and replace a 35-foot tall freestanding sign located at the southeast corner of the lot with a new 35-foot tall freestanding sign. The new freestanding sign will be designed to meet U-Haul's corporate sign design and colors. Rosemead Municipal Code, Section 17.28.020(C), provides the criteria by which the Planning Commission may approve, approve with conditions, or disapprove an application: A. The plans indicate proper consideration for the relationship between the proposed building and site developments that exist or have been approved for the general neighborhood. The proposed project solely consists of renovating the exterior façade of an existing U-Haul and the removal and replacement of the freestanding sign. The project would not modify the existing use and site configuration. The proposed exterior façade design would be complementary to the existing developments in the vicinity. B. The plan for the proposed structure and site development indicates the manner in which the proposed development and surrounding properties are protected against noise, vibrations, and other factors which may have an adverse effect on the environment, and the manner of screening mechanical equipment, trash, storage and loading areas. The proposed project solely consists of renovating the exterior facade of an existing U-Haul and the removal and replacement of the freestanding sign. The proposed project would not add new floor area to the existing building, affect the existing floor plan, or change the existing site layout. As such, the proposed • project would not produce any foreseeable adverse impacts. All construction work would be required to comply with the timeframe and decibel levels indicated in the City of Rosemead Noise Ordinance. Conditions of approval specifically address factors such as construction hours, screening of mechanical equipment, landscaping, and the overall maintenance of the property. C. The proposed building or site development is not, in its exterior design and appearance, so at variance with the appearance of other existing buildings or site developments in the neighborhood as to cause the nature of the local environment to materially depreciate in appearance and value. The proposed exterior facade renovation of U-Haul's existing buildings and the removal and replacement of the freestanding sign would complement the existing commercial site developments within the vicinity of the subject site. The proposed project utilizes colors, material, and decorative elements that would not be at variance with the appearance of existing neighboring buildings. As such, Planning Commission Meeting June 20,2016 Page 6 of 15 approval of the proposed project would not cause the nature of the local environment to materially depreciate in appearance and value. D. The proposed building or structure is in harmony with the proposed developments on land in the general area, especially those instances where buildings are within or adjacent to land shown on the General Plan as being part of the Civic Center or in public or educational use, or are within or immediately adjacent to land included within any precise plan which indicates building shape, size, or style. The proposed project solely consists of renovating the exterior façade of an existing U-Haul and the removal and replacement of the freestanding sign. The proposed project would not add new floor area to the existing building, affect the existing floor plan, or change the existing site layout. The proposed exterior renovation would complement the existing commercial site developments within the vicinity of the subject site. In addition, the property is not part of the Civic Center or in public or education use or are within or immediately immedicately adjacent to land included within any precise plan which indicates building shape. size, or style. E. The proposed development is in conformity with the standards of this Code and other applicable ordinances in so far as the location and appearance of the buildings and structures are involved. The proposed project solely consists of renovating the exterior facade of an existing U-Haul and the removal and replacement of the freestanding sign. The proposed project would not add new floor area to the existing building, affect the existing floor plan, or change the existing site layout. The proposed exterior façade design of the existing building would complement the existing commercial site developments within the vicinity of the subject site. The removal and replace of the freestanding sign meets all code standards. As such, the proposed project would be in conformity with the standards of the Zoning Code and other applicable ordinances in so far as the location and appearance of the buildings and structures are involved. F. The site plan and the design of the buildings, parking areas, signs, landscaping, luminaries, and other site features indicates that proper consideration has been given to both the functional aspects of the site development, such as automobile and pedestrian circulation, and the visual effect of the development from the view of public streets. The proposed project solely consists of renovating the exterior façade of an existing U-Haul and the removal and replacement of the freestanding sign. The site plan and design of the parking areas, signs, landscaping. luminaries, and other site features would not be affected by the proposed project. THE SUBJECT PROPERTY IS LOCATED AT 3527 IVAR AVENUE (APN: 5390-018-033), IN THE C-3/D-0 (MEDIUM COMMERCIAL WITH DESIGN OVERLAY) ZONE WHEREAS, on January 29, 2015, U-Haul submitted a Modification application to renovate the exterior facade of an existing U-Haul and the removal and replacement of the freestanding sign, located at 3527 Ivar Avenue; WHEREAS, 3527 Ivar Avenue is located in a C-31D-O (Medium Commercial with Design Overlay) zoning district; WHEREAS, Section 17.28.020(C) of the Rosemead Municipal Code provides the criteria for a Design Review: WHEREAS, Sections 65800 & 65900 of the California Government Code and Section 17.28.020(C) of the Rosemead Municipal Code authorize the Planning Commission to approve, conditionally approve, or deny Design Review applications; WHEREAS, on June 9, 2016, twenty-four (24) notices were sent to property owners within a 300-foot radius from the subject property, the notice was published in the Rosemead Reader, and notices were posted in six (6) public locations and on site, specifying the availability of the application, and the date, time, and location of the public hearing for Modification 15-01; WHEREAS, on June 20, 2016, the Planning Commission held a duly noticed and advertised public hearing to receive oral and written testimony relative to Modification 15-01; and WHEREAS, the Rosemead Planning Commission has sufficiently considered all testimony presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Rosemead as follows: SECTION 1. Modification 15-01 ('`Project") is approved for for the modification of Design Review 86-18 to renovate the exterior facade of an existing U-Haul and to remove and replace the freestanding sing located along the southeast corner of the lot, in accordance with the staff report and Exhibit "B". Any revisions to the approved plans must be resubmitted for Planning Division review and, if satisfactory, approval.. 2. The following conditions must be complied to the satisfaction of the Planning Division prior to final approval of the associated plans, building permits, occupancy permits, or any other appropriate request. 3. The conditions listed on this exhibit shall be copied directly onto any development plans subsequently submitted to the Planning and Building Divisions. 4. Approval of Project shall not take effect for any purpose until the applicants) have filed with the City of Rosemead ("City") a notarized affidavit stating that he/she is aware of and accepts all of the conditions of approval as set forth in the letter of approval and this list of conditions within ten (10) days from the Planning Commission approval date. 5. The on-site public hearing notice posting shall be removed by the end of the 10- day appeal period of Project. 6. Project is approved for a period of one (1) year. The applicant(s) shall commence the approved project or request an extension within 30 calendar days prior to expiration. The one (1) year initial approval period shall be effective from the Planning Commission approval date. For the purpose of this petition, project commencement shall be defined as beginning the permitting process with the Planning and Building Divisions, so long as the project is not abandoned. The Planning Commission hereby authorizes the Planning Division to make and/or approve minor modifications to the project and to these conditions of approval. 8. Project is granted or approved with the City and its Planning Commission and City Council retaining and reserving the right and jurisdiction to review and to modify the permit, including the conditions of approval based on changed circumstances. Changed circumstances include, but are not limited to, the modification of the use, a change in scope, emphasis, size, or nature of the use, or the expansion, alteration, reconfiguration, or change of use. This reservation of right to review is in addition to, and not in lieu of, the right of the City, its Planning Commission, and City Council to review and revoke or modify any permit granted or approved under the Rosemead Municipal Code for any violations of the conditions imposed on Project. 9. The applicant(s) shall defend, indemnify, and hold harmless the City of Rosemead or its agents, officers, and employees from any claim, action, or proceeding against the City of Rosemead or its agents, officers, or employees to attack, set side, void, or annul, an approval of the Planning Commission and/or City Council concerning the project, which action is brought within the time period provided by law. 10. The applicant(s) shall comply with all Federal, State, and local laws relative to the approved use, including the requirements of the Planning, Building. Fire, Sheriff, and Health Departments. 11. Building permits will not be issued in connection with any project until such time as all plan check fees and all other applicable fees are paid in full. Prior to issuance of building permits, any required school fees shall be paid. The applicant shall provide the City with written verification of compliance from the applicable school districts. 12. The numbers of the address signs shall be at least six (6) inches tall with a minimum character width of 3/4 inch, contrasting in color and easily visible at driver's level from the street. Materials, colors, location, and size of such address numbers shall be approved by the Community Development Director, or his/her designee, prior to installation. 13. The hours of construction shall be limited from 7:00 a.m. to 8:00 p.m., Monday through Saturday. No construction shall take place on Sundays or on any federal holiday, without prior approval by the City. The applicant shall abide by the noise control sections of the Rosemead Municipal Code. 14. The Building Division, Planning Division, and Engineering Division shall have access to the project site at any time during construction to monitor progress. All requirements of the Building and Safety Division, Planning Division, and Engineering Division shall be complied with prior to the final approval of the proposed construction. 16. All landscaping shall be maintained in a neat and healthy condition. 17. The site shall be maintained in a clean, weed and litter free state. 18. Violations of the conditions of approval may result in citation and/or initiation of revocation proceedings. Project Specific Conditions of Approval 19. All conditions of Case Nos.: DESIGN REVIEW 86-18 and CONDITIONAL USE PERMIT 86-354 must be complied with to the satisfaction of the Community Development Director. 20. All awnings shall be power-washed periodically. 21. All building signage shall be reviewed and approved by the Planning Division as a separate Sign Plan Review. That no person shall reside in the manager's unit who has been convicted of burglary or theft, and a Sheriff Department clearance shall be obtained for any individual who occupies such manager's unit not later than thirty (30) days after such occupancy commences. F. Landscaping. A landscaped strip of not less than five (5' ) feet in width shall be provided, irrigated with sprinklers, and permanently maintained along the front lot line and abutting street rights-of-way, unless a greater landscape setback area and requirements are prescribed by other sections in this Code. Where the lot is adjacent to a residential zoning district, a twenty-five (25) foot landscaped yard shall be provided on the lot adjacent to the residential zoning district, and a twenty (20' ) foot landscaped yard shall. be provided on the lot adjacent to the residential zoning district, and a twenty (20' ) foot landscaped front yard shall be provided where within 100 feet of a residential zoning district or where across the street from a residential zoning district. The landscaping shall be in addition to any architectural screening type fence or face of the structure which shall be designed to screen the use from the residential neighborhood. Such fence, when required, shall be solid and constructed to prevent the passage of debris or light and constructed of either brick, stone, architectural tile, masonry units, wood, or other similar material (not including woven wire) and shall be not less than six (6' ) feet nor more than eight (8' ) feet in height. G. All driveways, parking, loading, and vehicle circulation areas shall be paved with concrete, asphalt, or asphaltic concrete. Vehicular ingress-egress shall be limited to one point for each side of the property abutting any street lot line. I. Off street parking. Off-street parking shall be required on the basis of one space for each 17,500 square feet of gross floor area in the facility. J. Lighting. All lights shall be shielded to direct light onto the uses established and away from adjacent property, but they may be of sufficient intensity to discourage vandalism and theft. K. Storage. All storage on the property shall be kept within an enclosed building. L. Miscellaneous activities. No activities such as miscellaneous or garage sales shall be conducted on the premises. M. Repairs. The servicing or repair of motor vehicles, boats, trailers, lawn mowers, and other similar equipment shall not be conducted on the premises. N. Planting materials. All areas not paved shall be landscaped with deciduous and coniferous plant materials. The landscaping plan shall be approved by the Planning Department. Maintenance of the landscaping shall be sufficient to maintain it in good condition. 0. Trash and debris.
