MANIS, CITY MANAGER /..t DATE: APRIL 25, 2017 SUBJECT: INSTALLATION OF GREEN CURB —WEST SIDE OF THE DRIVEWAY APRON AT 8424 GARVEY AVENUE SUMMARY At the February 2, 2017, Traffic Commission meeting, the Commission reviewed conditions at the automotive sales and service business located at 8424 Garvey Avenue and recommended the installation of green curbing, approximately 30-feet, between the property's two driveway aprons. This item was brought to the Traffic Commission at the request from the business owner at 8424 Garvey Avenue, to review conditions in this area for a green curb. The owner believes that the 20-minute green curb parking zone is pertinent for his business. The owner claims the curb is used by hundreds of his clients who stop by monthly to make car payments as well as drive by shoppers. The business owner also stated that when vehicles park on the adjacent curbs for long periods, it makes it difficult for customers to visit his business and blocks the view of oncoming traffic for vehicles exiting his parking lot. A green curb was previously installed by the business owner and removed by the City sometime in August 2016. Staff reviewed the request with a traffic engineering consultant and recommended to the Traffic Commission that 30-feet of green curbing be added in front of the business' parking lot (between driveways) at 8424 Garvey Avenue to allow for easier access for customers and to improve visibility. RECOMMENDATION That the City Council approve the Traffic Commission's recommendation to paint 30-feet of green curb in front of the business at 8424 Garvey Ave. between the property's two driveway aprons. DISCUSSION Garvey Avenue is an east-west arterial street with two lanes of travel in each direction. There is parking permitted on both sides of the street, with 2-hour parking designated along its length from 7 a.m. to 6 p.m. excluding Sunday. Garvey Avenue is approximately 75 feet wide and the posted speed limit is 35 MPH. Customers frequently come in to make car payments or to look at vehicles for purchase. The used car lot, Vehicle Center, is open Monday thru Sunday from 1:00 p.m. to 5:30 p.m. The land use of the adjacent property to the west at 8408/8416 Garvey Avenue is the Garvey Garden Plaza which is under construction and zoned mixed use residential/commercial and the business to the east at 8438 Garvey Avenue is an automotive body shop. On-street parking in front of 8424 Garvey between the property's two driveway aprons has space for one vehicle or two small compact vehicles. There are two driveway access points for the business located at 8424 Garvey Avenue but only one is in use. Access to this driveway is often hindered by parked vehicles obstructing visibility. The installation of a "20 Minute Parking" spaces will allow for easier access for business customers and will improve visibility for driveway access. FINANCIAL IMPACT Funding for this type of roadway improvement is included in the annual maintenance and operations budget for Fiscal Year 2016-17 under the Public Works Department, Field Services Division. ENVIRONMENTAL REVIEW This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (C) of the CEQA Implementing Guidelines. The requesting party is the owner of the business at 8424 Garvey Avenue. The owner stated that the green curb in front of his business was removed sometime in August 2016 and he would like the green curb to be re-installed. The owner believes that the 20-minute green curb parking zone is pertinent for his business since it is used by hundreds of his clients stopping by each month to make car payments as well as drive by shoppers. When vehicles are parked on the adjacent curbs for a long period, it makes it difficult for the large volume of customers coming and going from his business. This item was presented during the December 08, 2016 Traffic Commission meeting, during this meeting it was decided to hold off on recommendations until the business owner was available and present to answer questions, records of citations issued along Garvey Avenue for vehicles parking longer than the allowed 2-hours were obtained as well as a site plan of the property submitted to the Planning and Building Department. STAFF RECOMMENDATION It is recommended that the Traffic Commission proposed to the City Council that 30 feet of green curb be installed in front of the business at 8424 Garvey Avenue west of the driveway apron. OLD BUSINESS A. REVIEW FOR REQUEST FOR 20 MINUTE PARKING ZONE (GREEN CURB) 8424 GARVEY AVENUE Business Owner, Sherman Rourman thanked the Traffic Commissioners for their consideration and asked if they can reconsider tc reinstall the green curb he hand painted in front of his business that was removed by the City. He also mentioned that he keeps the gates closed to his business during business hours to avoid customers from driving on to his property because it is unsafe to exit out of his driveway when a vehicle is parked in front of his business. Mr. Rourman also mentioned that when the construction is completed and the new businesses come in they will be parking in front of his business and his customers will no longer have parking. Commissioner Hall visited the site and asked Mr. Rourman what the second driveway is used for. Mr. Rourman replied that he blocks the driveway because people don't read the signs and drive on to his property. Commissioner Hall mentioned that when she was at the.ocation she notice a 2 hour parking signs posted near the second driveway of his business and questioned how the green curb got there. She also asked Mr. Rourman if he's made this request in the past. Mr. Rourman replied that he requested a green curb in the past but was denied, he appealed the denial and when the item was presented to the City Council they also denied it,so he didn't have any other choice than to paint the green curb himself. Commissioner Hall commented that within the time she was at the location she didn't see anyone utilize the parking spot in front of his business. Mrs Hall also mentioned that Mr. Rourman currently doesn't have handicap or on- site parking for his customers and suggested that if Mr. Rourman were to rearrange the vehicles on his property he wculd be able to provide both handicap and on-site parking for his customers. Mr. Rourman replied that all his employee's park inside his property Commissioner Hall mentioned that the area where Mr. Rourman is requesting the green curb only has enough space for one vehicle and doesn't think that will solve his problem. She also asked Mr. Rourman what he would think if the City were to paint the curb red instead of green. Mr. Rourman repiied that it would affect his business because his customers won't be able to make payments if it's painted red. Commissioner Hall asked Mr. Rourman if he knew if the City has gone out to do a traffic study. Mr. Rourman didn't respond to Commissioner Hall's question and mentioned that it's unsafe pulling out of his driveway when vehicles are parked in front of his business. Commissioner Hall asked Mr. Rourman if he would rearrange the way he parked his vehicles on his property he will be able to provide on-site parking for his customers, because due to the information that he provided of only having his business open for 4 hours a day doesn't seem to justify having a green curb in front of his business. She also mentioned that she spent an hour and a half at the site and didn't see many customers stop by to make payments and noticed that there was one of his trucks parked in front of his business. Vice Chair Masuda asked Mr. Rourman if he has parking spaces available for his customers to park en-site. Mr. Rourman replied that his customers making payments or looking at cars aren't allowed to park on-site, but customers who are buying cars are allowed to park on-site but will need to wait for them to open the fence to allow them to enter the prope.'ty. Rosemead Traffic Commission Meeting Meeting Minutes of February 2,2017 Page 2 of 4 Vice Chair Masuda stated that depending on the type of businesses coming in they may need more than 20 minutes to conduct the type of service they will be offering and will not be able to use that parking spot. He also mentioned that with the safety concerns Mr. Rourman stated it would be better to have part of the curb palmed red. Commissioner Hall mentioned that business owners are usually required to provide handicap and on-site parking for their customers and doesn't think it's right to give a business their own personal parking spot n front of their business. Mr.Rourman replied that he allows his employee's to park on his property so his customers making payments and looking at cars can park in front of his business. But now that the City removed his green curb it's inconvenient for his customers because people from other businesses can now park in his parking spot. Chair Russell-Chavez asked Vice Chair Masuda if he can clarify the concerns he mentioned will happen if they approved this request. Vice Chair Masuda replied that he really didn't have concerns because each request is handled on a case by case basis because every situation is different. Commissioner Quintanilla thanked Mr. Rourmen for coming to the meeting. Chair Russell-Chavez commented that there are similar traffic concerns throughout Garvey Avenue and it's usually the responsibility of the driver exiting a driveway to make sure and check that there are no pedestrians or oncoming traffic before pulling out of a driveway. Chair Russell-Chavez also mentioned that if the green curb were to get approved in front of his business he would need to understand that it's not only for his use and enforcing the 20 minute parking limit may be difficult. Mr. Rourman agreed with Chair Russell-Chavez,but expressed that his concern is that the cars parking in front of his business will affect his business because people can't see the cars on his lot. Chair Russell-Chavez explained once again if the curb were to be installed in from of his business that doesn't mean he owns it and anyone can park in that spot. Mr. Rourman understand it's not his green curb because the City took it away and now that it has been removed vehicles are parking in that spot for a long period of time. Chair Russell-Chavez asked if staff can ask code enforcement to monitor that area and also informed Mr.Rourman that the parking spot is there for everyone to use. Mr. Rourman replied that he understands that the parking spot doesn't belong to him. Karen Vigil from Transtech informed the Traffic Commissioner that they were able to obtain the information that was requested by the Commissioners:the plans submitted to the planning department where it shows the business owner will provide on-site parking,current pictures of the business and records of the citation history for the last 2 years on Garvey Avenue between Earle Avenue and Delta Avenue. Staffs recommendations remains the same, but due to the new information provided staff seeks further direction on how to proceed with the request. Chair Russell-Chavez expressed her pros and cons for the request, Her pros would ae that it would benefit the car lot and it may also benefit the new businesses coming in, her cons would be that depending on the type of businesses coming in next door they may not be able to benefit from it and may cause problems in the future. She would like to be fair to everyone and doesn't just want to favor one person. Vice Chair Masuda stated that if they approve the green curb now and then see that the new businesses aren't able to use that parking they can remove it and replace it with something everyone can use. He a so suggested if safety was an issue then it would be better to paint the curb red. Commissioner Hall expressed her concerns with what was said by Mr.Rourman of having to go out onto the street to stop oncoming traffic when someone is trying to exit his driveway because it is difficult to see the approaching traffic when somebody is parked in front of his business,and she would also prefer having a red curb instead of a green curb. Vice Chair Masuda motioned, second by Commissioner Quintanilla to approve staffs recommendation that the Traffic Commission proposed to the City Council that 30 feet of green curb be installed in front of the business at 8424 Garvey Avenue west of the driveway apron. Commissioner Hall asked staff if it would be possible to talk with the Post Office Manager and ask if they can install ADA accessible drive thru mailboxes,along with replacing the missing No Parking sign in front of the Post Office. Commissioner Quintanilla thanked staff for providing them with the extra information for the previous item. Mr. Quintanilla also asked for an update on the Safe Route to School Project. Chair Russell-Chavez asked if staff had any updates on the Jay Imperial Park Project and she was also glad that the City is moving forward on the signal improvements on Rush Street and Potrero Grande Drive. 6. The requesting party is the owner of the business at 8424 Garvey Avenue. The owner stated that the green curb in front of his business was removed sometime in August 2016 and he would like the green curb to re-installed. The owner believes that the 20-minute green curb parking zone is pertinent for his business since it is used by hundreds of his clients stopping by each month to make car payments and drive by shoppers. When vehicles are parked on the adjacent curbs for a long period, it makes it difficult for the large volume of customers coming and going from this business. STAFF RECOMMENDATION It is recommended that the Traffic Commission recommend to the City Council that 30 feet of green curb be installed in front of the business at 8424 Garvey Avenue west of the driveway apron. ANALYSIS Garvey Avenue: Garvey Avenue is an east-west arterial street with two lanes of travel in each direction and parking permitted on both sides of the street with 2-hour parking designated along its length from 7AM to 6PM excluding Sunday. Garvey Avenue is approximately 75 feet wide and the posted speed limit is 35 MPH. The nature of the business at 8424 Garvey is automobile sales and services, customers frequently come in to make car payments or to look at vehicles for purchase. The used car lot, Vehicle Center, is open Monday thru Sunday from 1:00 pm to 5:30 pm. The land use of the adjacent property to the east at 8408/8416 Garvey Avenue is defined as mixed-use residential/commercial and the business to the west at 8438 Garvey Avenue is another car dealership. There are two driveway access points for the business located at 8424 Garvey Avenue but only one is in use. Access to this driveway is often hindered by parked vehicles obstructing visibility. The installation of the "20 Minute Parking" spaces will allow for easier in and out access for business customers and will improve visibility for driveway access. Additionally, a small section of curbing which does not conform to a standard parking space will be painted red to prevent unauthorized parking in this area. Commissioner Hall visited the location and noticed several signs on the property and it was unclear on what type of services are being provided. She also mentioned that a business owner is usually responsible for providing on- site parking for customers. Mrs. Hall also mentioned that there is a second driveway to the property and if the business owner were to open it up the customers would be able to drive thru to make their payments. Chair Russell-Chavez asked if there's other green curbs throughout the City. Staff informed the Commission that we do have other green curbs throughout the City. Chair Russell-Chavez suggested in possibly installing a restricted 30 minute parking from Monday thru Friday between the hours of 8am — 5pm with no restrictions on weekends, to also allow other businesses to use the parking spot. Special Rosemead Traffic Commission Meeting Meeting Minutes of December 8,2016 Page 1 of 4 Traffic Consultant,Jana Robbins stated that she understood that the business owner was making the request so it can be utilized by his customers making payments or for someone wanting to see a car. She also mentioned that without knowing the type of businesses going on next door she is not sure if they will be able to utilize the parking spot. Commissioner Hall commented that after reviewing the pictures that were provided in the agenda she noticed that they have a big property and if they organized their equipment they will be able to provide on-site parking for their customers. She also mentioned that they have a second entrance to the property that is closed and if the business owner were to open it the customers will be able to drive in. Vice Chair Masuda mentioned that he looked at the location and without knowing the type of businesses that are surrounding it, it's difficult to make a recommendation on what would be suitable for everyone to use. Mr. Masuda also mentioned that it's not clear on the type of services being provided at that location. Commissioner Quintanilla slated that he would have liked for Mr. Sherman to have attended the meeting so he could have answered their questions. Commissioner Ornelas mentioned that there is currently 2 hour parking restrictions on Garvey Avenue and asked if Public Safety enforced the parking restrictions. Chair Russell-Chavez stated she would like to provide a parking spot that would be equitable for everyone. Commissioner Quintanilla asked staff if they had the guidelines to having a restricted parking in front of your business. Traffic Consultant,Jana Robbins informed the Commissioners that the guidelines to each request is different,due to the type of request and location. Vice Chair Masuda expressed that he was concerned with approving the request because of the type of precedent it may set for the future. He also mentioned that when someone usually makes a request for restricted parking they usually attend the meeting and would've liked the property owner to have been present to answer their questions. Staff informed the Traffic Commissioners that when the property owner called to make his request he mentioned that big trucks parked in front of his business for several hours and it's hard to see the on-coming traffic when exiting his driveway. He also mentioned that he was going to be present to tonight's meeting but wasn't here, so staff is recommending for the item to be tabled to the next meeting to allow staff to contact the property owner and ask him to attend the meeting. Commissioner Hall mentioned that it may have been a one-time occurrence when the truck parked in that spot and the green curb may not be needed. Vice Chair Masuda is concerned that if they approve the request other businesses will also be wanting the same thing. Chair Russell-Chavez requested to table the item to the next meeting to allow staff and the Commissioners to do further research before making their decision. Commissioner Ornelas expressed that with the new businesses coming in they may have to change the parking restriction to make it suitable for the new businesses. Chair Russell-Chavez suggested that before making any decisions they should take into consideration the surrounding and new businesses that will be coming in. She also asked staff if a business owner is required to provide on-site customer parking. This request has been forwarded to the Traffic Commission for review as staff found that the request does not warrant the installation of time-restricted parking curb marking in addition to the two-hour restriction currently in place for Garvey Avenue. STAFF RECOMMENDATION It is recommended that the Traffic Commission direct the Engineering Division how to proceed with the request for the installation of a 20-minute green curb marking in front of 8408/8416 Garvey Avenue. ANALYSIS Garvey Avenue is a major arterial in a commercial district. Currently Garvey Avenue is restricted for two-hour parking and has adequate signage. The requested location for the 20-minute parking zone curb marking (green curb) is abutting 8424 Garvey Avenue to the west in front of 8408/8416 Garvey Avenue. The nature of the business at 8424 Garvey is automobile sales and services. There is currently green curb painted in front of the business. There are no available records to indicate the existing green curb marking was ordered by the City. A field review and interviews with the business owner and property owners of the adjacent properties where the green curb is requested were utilized by Public Works Department when reviewing time-restricted parking application with the following considerations: 1. The parking demand for the residents and businesses on Garvey Avenue 2. The proximity from the applicant's business to the intended location Traffic Commission Meeting June 4,2015 Page 2 of 2 3. The impact to the business/residents directly in front of the requested location 4. The on-street parking is currently restricted to two-hour parking with adequate signage 5. The line of sight for egress from the properties 6. The natures of the businesses in the area, e.g., dry cleaning, food-to-go restaurants, and Post Office. The Public Works Department has determined that the demand for parking on Garvey Avenue is high. The intended location for the green curb is further away from the existing green curb in front of the auto sales business and likely will impact the business and residents next door. The current two-hour parking restriction is compatible with zoning and the nature of the business in the area. The sight line for vehicles traveling on eastbound Garvey Avenue is likely restricted more by the existing parking in front of 8424 Garvey Avenue than that 8408/8416 Garvey Avenue. At the conclusion of the investigation, staff did not find enough justifications for addition on-street 20 minute parking zone curb marking as requested.
