5. PUBLIC HEARINGS
A. Public Hearing on Conditional Use Permit 16-08, a City Initiated Request for
Review
The City is initiating a Request for Review, requested by Council Member Steven
Ly under Rosemead Municipal Code (RMC) Section 17.160.060, to further review
Conditional Use Permit 16-08. On November 27, 2017, the Planning Commission
adopted a denial Resolution for Conditional Use Permit 16-08 to operate a place of
religious assembly. The subject site is located at 7516 Emerson Place, in the Light
Multiple Residential (R-2) zone.
Recommendation: That the City Council either uphold or reverse the Planning
Commission's decision for Conditional Use Permit 16-08 and adopt or deny
Resolution No. 2017-66 (Attachment "A" or "B").

B. City Council Meeting Minutes
Recommendation: That the City Council approve the minutes from the regular
meeting on November 14, 2017, and the special meeting on December 6, 2017.
C. Proposed Adoption of Fourth Amendment to the San Gabriel Valley Council of
Governments Joint Powers Agreement
The San Gabriel Valley Council of Governments (SGVCOG) Governing Board
approved a draft version of the fourth amendment of the Joint Powers Agreement
(JPA) on Thursday, October 19, 2017. The Executive Committee provided final
review of the JPA and approved for member agency transmission on Monday,
November 6, 2017. Any revision of the JPA requires the approval of the governing
bodies of a majority of the member agencies. The SGVCOG has circulated the
revised JPA for adoption for all member agencies. The primary purpose for the
revisions to the JPA is to expand the jurisdiction of the SGVCOG's construction
scope to include projects anywhere in the San Gabriel Valley.

Recommendation: It is recommended that the City Council adopt Resolution No.
2017-67, approving the fourth Amendment to the San Gabriel Valley Council of
Governments' (SGVCOG) Joint Powers Agreement (JPA).

JOINT POWERS AGREEMENT AS ADOPTED BY THE
COUNCIL'S GOVERNING BOARD
D. Proposed City of Rosemead/County of Los Angeles Cooperative Agreement —
Bridge Preventive Maintenance Program
On September 19, 2008, the County of Los Angeles Department of Public Works
received Federal funding through the California Department of Transportation
(Caltrans) to develop and prepare a comprehensive Bridge Preventive Maintenance
Program (BPMP) for approximately 1,064 bridges located in 68 cities within the
County and unincorporated County areas. The implementation of this BPMP will
extend the service life of these bridges at a reduced cost by correcting minor
structural deficiencies before they become more costly repair.
On May 31, 2016, City staff took advantage of the opportunity to participate in the
BPMP and initiated the process by submitting a service request for all 13 City
bridges to the County. Under the BPMP, the following services are provided:
Perform preliminary engineering in compliance with California Department of
Transportation (Caltrans) and Federal Highway Administration (FHWA)
standards; seek reimbursement from Caltrans; credit reimbursement to the City;
provide a final accounting cost; prepare a cooperative agreement for construction,
preparation of plans, specifications, and cost estimates; right-of-way engineering,
utility engineering, and other work necessary to solicit construction bids; award and
administer the construction contract; and, do all things necessary and proper to
complete the project and act on behalf of City in all negotiations pertaining thereto.
Out of the 13 bridges, 7 were found eligible to be included in the BPMP. In order
to move forward with these 7 bridges, the City must enter into a cooperative
agreement with County of Los Angeles and agree to a local share cost of $75,000.
Recommendation: It is recommended that the City Council enter into a cooperative
agreement with County of Los Angeles for the Bridge Preventive Maintenance
Program in the amount of $75,000.
E. 2018 City Council Meeting Schedule
City Council meetings are held on the second and fourth Tuesdays of each month
at 7:00 p.m. Historically, the City Council has cancelled the second meeting in
August (summer break), November (Thanksgiving), and December (Christmas).
The proposed meeting schedule is attached. Adopting a meeting schedule will give
the City Council, staff, and the community the ability to plan their schedules

accordingly. The City Council maintains the ability to adjust, cancel, and/or add
other meetings dates, as deemed appropriate.
Recommendation: It is recommended that the City Council adopt a City Council
meeting schedule for the 2018 calendar year.
F. Resolution 2017-61 — Resolution to Uphold the Planning Commission's Decision
for Modification 17-05
On November 14, 2017, the City Council considered a Request for Review,
requested by Council Member Margaret Clark to further review Modification 17-
05 for the project located at 9036-9038 Garvey Avenue. Modification 17-05 was
approved by the Planning Commission on October 16, 2017, to re-classify the
commercial component of a previously approved mixed-use project to a shopping
center use for the incorporation of restaurant use. After receiving all oral and
written testimony, the City Council upheld the Planning Commission's decision
and directed staff to present the resolution at the next City Council meeting. For
further information on the item, the prior Planning Commission and City Council
staff reports are attached.
Recommendation: It is recommended that the City Council adopt Resolution 2017-
61, consistent with its direction provided at the November 14, 2017, Council
Meeting to uphold the Planning Commission's decision for Modification 17-05.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

COMMISSION'S DECISION FOR MODIFICATION 17-05, A
MODIFICATION OF DESIGN REVIEW 14-06, TO RE-
CLASSIFY THE COMMERCIAL COMPONENT OF THE
MIXED USE PROJECT TO A SHOPPING CENTER USE, FOR
THE INCORPORATION OF RESTAURANT USE IN FIVE OUT
OF THE FIVE UNITS. THE SUBJECT SITE IS LOCATED AT
9036-38 GARVEY AVENUE, IN THE MEDIUM COMMERCIAL
WITH A MIXED USE AND DESIGN OVERLAY (C-3/MUDO/D-
0) ZONE (APN: 5282-026-052)
G. HR Dynamics & Performance Management, Inc., Professional Services Agreement
On April 25, 2017, the City Council authorized the City Manager to execute a
professional services agreement with HR Dynamics & Performance Management,
Inc. for Human Resource services for an amount not to exceed $100,000. The City
is approaching the maximum limit per the agreement. Staff recommends the City
Council approve an amendment to the original agreement to increase the amount
by $50,000. In order to maintain Human Resource activities during the recruitment
of the Human Resources Manager position, staff recommends continuing to utilize
HR Dynamics & Performance Management, Inc., as they are familiar with the
City's policies and procedures as well as ongoing Human Resource matters.

Recommendation: It is recommended that the City Council authorize the City
Manager to execute an amendment to the professional services agreement with HR
Dynamics & Performance Management, Inc. for Human Resource services for an
amount not to exceed $150,000.
7. MATTERS FROM CITY MANAGER & STAFF
A. Traffic Signal Maintenance and Repair Agreement and Budget Amount Increase —
St. Francis Electric
St. Francis Electric is currently under a two-year contract that began January 1,
2017, with an option to renew for two additional years, to maintain and repair all
of the City -owned traffic signals at an annual cost of $106,950 or $8,912 monthly.
The scope of work per the agreement, approved by the City Council on December
13, 2016, provides a flat monthly fee for monitoring of all City -owned traffic
signals at an annual cost of $53,475. In addition, the City included $53,475 to cover
the cost of repairs and equipment upgrades. Due to a lack of responsiveness from
the previous contractor (Siemens Industries), there was a backlog of needed repairs
and necessary equipment upgrades, which was not accurately budgeted under the
contract with St. Francis Electric. As a result, St. Francis Electric's contract was
under budgeted. It is now anticipated that the actual amount needed is $172,039
annually or $14,337 monthly.
Expenditures for the first nine months of the contract period have exceeded the
contractual amount by $22,080 and are estimated to exceed the contractual amount
by $65,089 by the end of the contract period (January 2017 — December 2017). As
a result, it is necessary to increase the amount of the contract with St. Francis, as
well as increase the budgeted amount for FY 2017-18.
Recommendation: It is recommended that Council take the following actions:
Increase the annual contractual amount for St. Francis Electric by $73,050, for
a total amount of $180,000, which would include a 5% contingency.
2. Increase the budgeted amount for traffic signal maintenance for FY 2017-18 by
$30,000 for a total budget amount of $180,000.
B. Rosemead Boulevard Highway Safety Improvement Program
As part of the City's Fiscal Year 2010-11 Capital Improvement Program, the City
Council approved a Highway Safety Improvement Program (HSIP) project, which
involves traffic safety and calming enhancements along Rosemead Boulevard from
the Union Pacific Railroad Underpass/North City limit to Mission Drive. This
project is funded primarily through the State of California HSIP Program with a
total approximated approved grant of $454,000 and required City matching
contribution of approximate $58,000, for a total project approximation of $512,000.
The project's original scope of works included the installation of wider crosswalks,
City Council and the Successor Agency to the Rosemead

pedestrian lighting, landscaped parkways, new traffic safety striping, a bike lane,
signage, countdown pedestrian signals, and traffic signal improvements. Since
Rosemead Boulevard is a State-owned highway, the project requires an
encroachment permit from Caltrans prior to construction. Unfortunately, through
the submittal of the encroachment permit application, Caltrans eliminated most of
the originally proposed items and approved only the installation of the sidewalk
and minor traffic modifications at the intersection of Mission Drive and Valley
Boulevard along Rosemead Boulevard.
Recommendation: It is recommended that the City Council provide direction on
how they would like to proceed with the Rosemead Boulevard HSIP project.
S. MATTERS FROM MAYOR & CITY COUNCIL
A. Accessibility and Technology Reimbursement Administrative Policy (Agendized
by Councilmember Armenia)
This item is presented to the City Council at the request of Councilmember
Armenta. Councilmember Armenta would like to discuss Administrative Policy 30-
02: Accessibility and Technology Reimbursement Policy as it related to provision
B.
Provision B — Because these technologies are required to maintain contact with one
another, the City will provide the City Council, the City Manager, Department
Heads, and Division Heads an annual technology reimbursement that includes the
following components:
• Once per calendar year, participants will be qualified for a one-time
reimbursement amount of no more than $300 for the purchase of eligible
electronic devices. In order to be eligible for the reimbursement, receipts must
be turned in.
• Beginning in the month in which participants sign-up for this program, eligible
employees shall also receive a reimbursement of up to $150 per month for
applicable technology costs such as a voice and data plan. In order to be eligible
for the reimbursement, receipts must be turned in.
Recommendation: Discuss and provide direction to staff.
B. City Council Comments

The next regular City Council meeting is scheduled to take place on January 9, 2018, at
7:00 p.m. in the Rosemead City Hall Council Chamber.
