CC - Item 5F - Land Water Conservation Grant Program - Resolution Approving the Appication for Grant Funds - Garvey Dog ParkROSEMEAD CITY COUNCIL STAFF REPORT TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM: GLORIA MOLLEDA, CITY MANAGER �,tV \ DATE: JANUARY 23, 2018 SUBJECT: LAND WATER CONSERVATION GRANT PROGRAM - RESOLUTION NO. 2018-07, APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE CALIFORNIA DEPARTMENT OF PARKS AND RECREATION - GARVEY DOG PARK SUMMARY On February 14, 1963, President Kennedy's Administration proposed legislation to establish a federal Land and Water Conservation Fund (LWCF) to assist States in the planning, acquisition, and development of recreation lands. Funds allocated to California are administered by the California Department of Parks and Recreation, Office of Grants and Local Services under the provisions of the California Outdoor Recreation Resources Plan Act of 1967, (Public Resources Code §5099 et seq.). City staff is currently working with Global Urban Strategies to submit an application for the LWCF grant, which is due by February 5, 2018, for the creation of the Garvey Dog Park. Funding for the LWCF grant has been inconsistent and sparse in recent years, which leads officials to believe this grant cycle will be highly competitive. DISCUSSION The California Department of Parks and Recreation, Office of Grants and Local Services has released a Request for Proposals for the planning, acquisition, and development of parks. The LWCF grant is a reimbursement grant that has a 50% matching funds requirement. The City would be required to pay for the entire project upfront and then submit for reimbursement up to 50% of the project cost. Upon approval from the City Council, staff intends to submit an application to create a dog park at Garvey Park. With the opening of the new Public Works Corporate Yard on River Avenue, a portion of the west side of Garvey Park (see Attachment A) has become available, and serves as the most feasible and project ready location as this property is owned by the City. The dog park would occupy approximately 15,000 square feet (.35 acres) and include separate gated areas for large and small dogs with various possible amenities such as a decomposed ITEM NUMBER: City Council Meeting January 23, 2018 Page 2 of 3 granite surface, drinking fountains, benches, trash cans, and a shaded canopy. City staff is working on designing the project, and will work with the Parks Commission on amenity and layout suggestions before bringing the project back before the City Council for final approval. The total cost of the project is estimated to be $580,750 (see Attachment B). STAFF RECOMMENDATION It is recommended that the City Council take the following actions: 1. Adopt Resolution No. 2018-07 authorizing the submission of an application for the LWCF Grant Program to the California Department of Parks and Recreation for the creation of the Garvey Dog Park. 2. Appropriate $580,750 from the unassigned general fund balance. If approved for funding under the LWCF Grant Program, then 50% of this amount would be reimbursable to the City. FISCAL IMPACT The estimate project cost of the new dog park is $580,750, which would need to be appropriated from the unassigned general fund balance. If approved for funding under the LWCF Grant Program, the City would be required to pay for the entire project upfront, then submit for reimbursement up to 50% of the project cost. ENVIRONMENTAL REVIEW The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 (a) of the CEQA Implementation Guidelines. STRATEGIC PLAN IMPACT — None LEGAL REVIEW Resolution No. 2018-07 has been reviewed and approved by the City Attorney. Attachment C Resolution No. 2018-07 RESOLUTION NO. 2018-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPROVING THE APPLICATION FOR THE LAND AND WATER CONSERVATION FUND — GARVEY DOG PARK WHEREAS, the Congress under Public Law 88-578 has authorized the establishment of a federal Land and Water Conservation Fund program, providing matching funds to the State of California and its political subdivisions for acquiring lands and developing facilities for public outdoor recreation purposes; and WHEREAS, the California Department of Parks and Recreation is responsible for administration of the program in the State, setting up necessary rules and procedures governing applications by local agencies under the program; and WHEREAS, the City of Rosemead certifies by resolution the approval of the application and the availability of eligible matching funds prior to submission of the application to the State. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. That the City Council approves the filing of an application for Land and Water Conservation Fund for the proposed Garvey Dog Park; and SECTION 2. That the City Council agrees to abide by Section 6(f)(3) of Public Law 88- 578 which states "No property acquired or developed with assistance under this section shall, without the approval of the National Secretary of the Interior, be converted to other than public outdoor recreation uses. The Secretary shall approve such conversion only if he finds it to be in accord with the then existing comprehensive statewide outdoor recreation plan and only upon such conditions as he deems necessary to assure the substitution of other recreation properties of at least equal fair market value and of reasonably equivalent usefulness and location"; and SECTION 3. That the City Council certifies that the City of Rosemead has matching funds from eligible source(s) and can finance 100 percent of the Project, which up to half may be reimbursed; and SECTION 4. The City Manager, or a designee, is hereby authorized to conduct all negotiations and is designated as the Signature Authority to execute all documents necessary including (but not limited to) applications, contracts, amendments, payment requests, and compliance with all applicable current state and federal laws, which may be necessary for the completion of the aforementioned Garvey Dog Park project; and SECTION 5. That this authorization is effective until rescinded by Signature Authority or this Governing Body; and SECTION 6. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect. PASSED, APPROVED, AND ADOPTED this 23 d day of January, 2018.
