OF TITLE 17, AND ADDING CHAPTER 17.21 — GARVEY AVENUE SPECIFIC PLAN, ADOPTING SPECIFIC PLAN 14-01 • WHEREAS, the City of Rosemead is proposing the adoption of the Garvey Avenue Specific Plan(Specific Plan 14-01)that would establish allowed land uses,development standards, policies and guidelines to create an attractive and desirable neighborhood "main street" focusing on creating a vibrant corridor with visible pedestrian activity. WHEREAS, the Garvey Avenue Specific Plan area encompasses the 1.2-mile portion of Garvey Avenue between New Avenue and Charlotte Avenue. The area includes 88 acres (153 parcels) that abut Garvey Avenue. The area is characterized by long established community institutions (Garvey Intermediate School, Arlene Bitely Elementary School, and Jim's Burgers), newer iconic institutions (Boca Dharma Temple, the Square Shopping Center, and China Islamic Restaurant), which are interspersed among largely auto-oriented land uses. Vacant parcels make up 30.4% (nearly 27 acres) of the total project land area with no open space or parks. Approximately 55 acres of the project area is anticipated to be redeveloped over the life of the Garvey Avenue Specific Plan; and WHEREAS, the proposed Garvey Avenue Specific Plan would support the development of over 1.18 million square feet of commercial development, 892 dwelling units (DU), and 0.77 acres of open space. Street improvements in the Specific Plan area remodels the 100-foot wide Garvey Avenue with street landscaping, multimodal improvements, and lane reconfigurations. Suggested restoration of a street grid system at the LA Auto Auction Site and Landwin Property connecting Garvey Avenue and new neighborhood streets add to the roadway network of the area; and WHEREAS, the proposed Garvey Avenue Specific Plan is structured around flexible, innovative and proven approaches that ensure the area will have adequate infrastructure and public services to support the area's transformation. Chapter 3 builds on the foundation that the City previously established for the Garvey Avenue Master Plan; features design and development standards for walkability and consistently high-quality design, and expands the spectrum of available tools for community-wide improvements under the Community Benefits Incentives approach. Chapter 4 devotes and graphically illustrates ideas for transformation of catalytic opportunity sites at the LA Auto Auction, Landwin Property, and other sites, revitalization of the Alhambra Wash, and streetscape beautification and improvements. Chapter 5 presents streetscape treatments and street improvements options that facilitate Garvey Avenue renovation into a living street of pedestrians, bicyclists,and sidewalk diners. Chapter 6 recommends strategies to fund and finance the Garvey Avenue Specific Plan; it provides an Action Plan with specific directions for the day-to-day administration and long-term management of the Plan; and 1 • WHEREAS, the City of Rosemead has an adopted Zoning Code and associated maps,. including specific development standards to control development; and WHEREAS, State Planning and Zoning Law,and Rosemead Municipal Code Title 17 and Section 17.152.060, authorizes and sets standards for approval of Zone Change applications and governs development of private properties; and • WHEREAS,the Planning Commission is an advisory body to the City Council with regard to the approval of General Plan Amendments and Zone Changes; and WHEREAS, City of Rosemead policy encourages consistency of its Zoning Code with the General Plan and promotes separation of conflicting land uses through good planning practices; and WHEREAS, adoption of the Garvey Avenue Specific Plan requires approval of a Zone Map Amendment to the Rosemead official Zoning Map for the affected properties within the Garvey Avenue Specific Plan area from their respective mapping symbols of"C-3", "C-4", "R- 2", "P-D", and"P"to "SP"; and; WHEREAS,Chapter 17.150 of the Rosemead Municipal Code contains the provisions for adoption of a Specific Plan on properties zoned "SP" in accordance with Government Code Section 65450 and Government Code Section 65453; and WHEREAS, adoption of the Garvey Avenue Specific Plan (Specific Plan 14-01) amends Title 17 of the Rosemead Municipal Code and adds"Chapter 17.21-Garvey Avenue Specific Plan" regarding the requirements and provisions the Garvey Avenue Specific Plan (Specific Plan 14- 01); and WHEREAS, Program Environmental Impact Report (EIR) (SCH No. 2015041067) was prepared and completed for the project pursuant to the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City's environmental review guidelines for the implementation of CEQA; and WHEREAS, on January 17, 2018, the Planning Commission held a duly noticed and advertised public hearing to receive oral and written testimony relative to Final Program EIR(SCH No. 2015041067), Municipal Code Amendment 14-02, Zone Change 14-01, and the Garvey Avenue Specific Plan(Specific Plan 14-01) and adopted PC Resolution No. 18-01,recommending approval of Zone Change 14-01 and Municipal Code Amendment 14-02 to allow consistency between the Garvey Avenue Specific Plan and the City's Zoning Code; and WHEREAS, on February 3, 2018, notices were posted in six public locations and published in the San Gabriel Valley Tribune, specifying the date, time, and location of the public hearing to consider recommending the adoption of the Final Program EIR(SCH No. 2015041067) together with the recommendation to amend the General Plan and Zoning Code, approve a Zone Change, and adopt the Garvey Avenue Specific Plan (Specific Plan 14-01), pursuant to California Government Code Section 65091; and 2 WHEREAS, on February 13, 2018, the City Council held a duly noticed and advertised public hearing to receive oral and written testimony relative to Final Program EIR (SCH No. 2015041067), General Plan Amendment 14-01, Municipal Code Amendment 14-02,Zone Change 14-01, and the Garvey Avenue Specific Plan (Specific Plan 14-01); and WHEREAS, in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City's Environmental Review Guidelines, the City Council has reviewed and considered Final Program EIR (SCH No. 2015041067)and its appendices, together with Responses to Comments, comments received during the public hearing process, has made Findings of Fact, and has adopted Statements of Overriding Consideration and a Mitigation Monitoring Program,prior to approving Zone Change 14-01 and Municipal Code Amendment 14- 02; and WHEREAS,the City Council,having final approval authority,has sufficiently considered all testimony and public comment presented to them prior to taking action on the project and its environmental determination. NOW,THEREFORE,BE IT ORDAINED,by the City Council of the City of Rosemead as follows: SECTION 1. Environmental Review. The City Council has certified the Final Program EIR(SCH No. 2015041067) for the project by separate Resolution(Resolution No. 2018-06), and adopted Findings of Fact, Statements of Overriding Consideration and the Mitigation Monitoring Program in support of its action on Zone Change 14-01 and Municipal Code Amendment 14-02. SECTION 2. Municipal Code Amendment and Zoning Map Findings. The City Council HEREBY FINDS AND DETERMINES that facts do exist to justify approving Municipal Code Amendment 14-02 amending sections of Title 17, and adding Chapter 17.21 Garvey Avenue Specific Plan,and approving Zone Change 14-01 amending the official Zoning Map in accordance with Rosemead Municipal Code Section 17.152.060(B), as follows: A. The proposed amendments are consistent with the General Plan and any applicable specific plan; and FINDING: The proposed amendments are consistent with the General Plan in that the City Council approved General Plan Amendment 14-01 by separate Resolution and that amendment is limited to updates to certain figures, tables, text and terms to insure consistency between the City's General Plan and the Garvey Avenue Specific Plan and does not amend Goals, Objectives and Policies of the General Plan. With the approval of General Plan Amendment 14- 01; both Municipal Code Amendment 14-02 and Zone Change 14-01 are consistent with the 2010 Rosemead General Plan and specifically implements Goals contained in the Land Use, Circulation, Resource Management, Noise and Housing Elements. 3 B. The proposed amendments will not be detrimental to the public interest,health, safety, convenience,or welfare of the City; and FINDING: The proposed amendments will not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that Municipal Code Amendment 14-02 is limited to updates to the Zoning Ordinance text and Zone Change 14-01 updates the official Zoning Map, neither of which directly result in physical improvements. Each individual development or redevelopment of parcels within the Garvey Avenue Specific Plan area will be subject to subsequent environmental review and analysis for any potential impacts to the public's health, safety,convenience or welfare. Final Program EIR(SCH No. 2015041067)was prepared to study the potential environmental impacts that may result from implementation of the Garvey Avenue Specific Plan (Specific Plan 14-01) and when certified, includes the adoption of a Mitigation Monitoring Program, reducing any impacts to a less than significant effect. C. Rosemead Municipal Code Section 17.152.060(B)(3), specific to Zoning Code Amendments. The proposed amendment is internally consistent with other applicable provisions of this Zoning Code; and FINDING: The proposed Municipal Code Amendment 14-02 to Title 17, included as Exhibit "A" herein, will modify sections of the Zoning Code applicable to implementation of development or redevelopment of parcels specifically within the Garvey Avenue Specific Plan area and are necessary to ensure consistency of regulations and development standards unique to the Garvey Avenue Specific Plan without creating inconsistencies for existing zoning districts, land uses and their respective development standards. D. Rosemead Municipal Code Section 17.152.060(B)(4), specific to Zoning Map Amendments. The affected site is physically suitable in terms of design, location, operating characteristics, shape,size,topography,and the provision of public and emergency vehicle access, and public services and utilities and is served by highways and streets adequate in width and improvement to carry the kind and quantity of traffic the proposed use would likely generate, to ensure that the proposed use(s) and/or development will not endanger,jeopardize, or otherwise constitute a hazard to the property or improvements in the vicinity in which the property is located. FINDING: The proposed Zone Change 14-02 amending the official Zoning Map, included as Exhibit "B" herein, contains sites that are physically suitable to development or redevelopment as the physical properties encompass the 1.2-mile portion of Garvey Avenue between New Avenue and Charlotte Avenue. The area is an established commercial corridor of Rosemead, with long-standing residential communities where vacant and underutilized parcels can support development of over 1.18 million square feet of commercial development, 892 dwelling units (DU), and 0.77 acres of open space. Although Zone Change 14-01 does not directly result in development projects, implementation of provisions within the companion governing document, the Garvey Avenue Specific Plan (Specific Plan 14-01), contains regulations and standards to ensure that each project developed or redeveloped does not endanger, jeopardize, or create hazards to properties or improvements; and is carried out consistent with infrastructure funding, maintenance strategies, and all public right-of-way improvements. 4 SECTION 3. Additional Findings. The City Council HEREBY FURTHER FINDS AND DETERMINES that Zone Change 14-01 is in the best interest of the public necessity and general welfare,that good city planning practice dictates and supports the proposed Zone Change,and that the amendment to the Zoning Map will designate specific properties "SP", allowing for the adoption of a Specific Plan. SECTION 4. Amendment of Zoning Map. The City Council HEREBY AMENDS the City's official Zoning Map to change the zoning from "C-3", "C-4", "R-2", "P-D", and "P" to "SP" along the Garvey Avenue Specific Plan Area and DIRECTS City Staff to make the appropriate changes to the official Zoning Map. SECTION 5. Amendments to Title 17 of the Rosemead Municipal Code and Adoption of Garvey Avenue Specific Plan. The City Council HEREBY ADOPTS the Garvey Avenue Specific Plan(Specific Plan 14-01)by ADOPTING Municipal Code Amendment 14-02 amending various portions of Title 17 and adding Chapter 17.21, as set forth in Exhibits"A"and"C". SECTION 6. Severability. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 7. Publication. The City Clerk is directed to certify this ordinance and cause it to be published in the manner required by law. SECTION 8. Effective Date.
