TRIPEPI, CITY MANAGER DATE: APRIL 8, 1999 , RE: AB 1355 (HAVICE) - EASTERN LOS ANGELES COUNTY RIVERS AND MOUNTAINS CONSERVANCY This item was placed on the agenda at the request of Councilman Imperial. AB 1355 (Havice) is one of two bills in the Legislature seeking to create a conservancy for local rivers and watershed. AB 1355,however, differs from SB 216 in several ways. Primarily,the bill seeks to include both the San Gabriel and Los Angeles Rivers in the same conservancy. In addition, AB 1355 specifies that the proposed conservancy shall not take"action that is deemed by a member city to be a detriment to its interests," and requires the conservancy to obtain written approval from the City in which it proposes to take an action. Should the Council choose to take action on AB 1355, staff recommends supporting the bill with the inclusion of language that reflects the following amendments: • The Conservancy must have a governing board composed of a majority of elected city officials. • The Conservancy must conform to all laws, regulations, general and specific plans of the cities included within its boundaries. • The Conservancy shall not adopt policies or approve projects that interfere with any water rights established by court order, statute or permit. • The Conservancy shall not adopt policies or approve projects that have the potential to contaminate surface water, groundwater supplies or otherwise degrade the quality_of water in the Main San Gabriel Basin. (b) "Conservancy" means the Eastern Los Angeles County Rivers and Mountains Conservancy. (c) "Member city" means either a city or legislative body of a city located within the territorial jurisdiction of the conservancy, or a county or a legislative body of a county with respect to unincorporated territory within the territorial jurisdiction of the conservancy. (2) Incorporation, as relevant, the principals and planning work contained within the Los Angeles River Master Plan prepared by Los Angeles County. (3) Identification of underused existing public open spaces and recommendations for providing better public use and enjoyment of these areas. (4) Identification of,and a priorityprogram for implementing, those additional recreational and open-space needs.including additional or norladed facilities and Larks that may be necessary or desirable. (b) Approve conservancy funded projects that advance the policies and priorities set forth in subdivision(a). f c) Facilitate and coordinate its activities on projects undertaken pursuant to this division with the activities of the United States Army Corp of Engineers and the Los Angeles County Public Works Department on flood control projects. 32556. (a) (1)The term of each voting member of the governing • board, except the Mayor of the City of I.^c A. aalr. Long Beach , or his or het designee, shall be two years, or until his or her successor is appointed,whichever is longer. Because the City of Long Beach occupies a unique geographical position in that both the Los Angeles River and the San Gabriel River flow through and terminate within the city limits, the seat designated for the Mayor of the City of Long Beach, or a member of the Long Beach City Council designated by the mayor,shall have no limit on its term. The voting members of the board shall elect n chairperson, • vice chairperson. and other officers, as determined to be necessary, from among the board members and the terms of those offices shall be determined by the governing board. The conservancy may employ an executive effcws director and other necessary staff, and may enter into contracts for services requiring knowledge,experience, and ability not possessed by the conservancy staff. • 32559. Members of the board who are not full-fine public employees shall be,compensated at the rate of one hundred dollars (5100)per regular meeting, not to exceed 12 regular meetings per year, and the acmal•and necessary expenses incurred in the performance of their duties. Any member may waive the compensation or the expenses. 32560. A quonim of the board shall consist of not less than Cpsa-seven voting members of the governing board. All meetings of the board are • '• ubject to the Bagley-Keene Opne Meeting Act(Article 9 (commencing with Section 11120) of Chapter 1 or Part 1 of Division 3 of Title 2 of the Government Code). • 32561. The conservancy may manage, operate, administer, and maintain any land$s or facility it acquires,in accordance with thepurposes set forth in Section 32552. TM conservancy may adopt regulations governing the use by the public of any conservancy land or facility and may provide for the enforcement of those regulations. 32563, (a) The conservancy may acquire real property or any • interest in real property within the cbnservancy's territory from willing sellers and at fair market value or on other mutually acceptable terms,upon a fording that the acquisition is consistent with the purposes of the conservancy set forth in Section 32552. The conservancy may acquire the property itself or may coordinate the acquisition through other public agencies that have the authority to acquire property and that have available funding or land to exchange. The conservancy may hold.a remainder interest in those instances in which an owner desires to sell and retain a life estater•and The conservancy may create and administer a mitigation land bank and arrange land exchanges, as is consistent with the purposes set forth in Section 32552.. If the city council or board of supervisors objects to the proposed acquisition,the conservancy shall hold a noticed public hearing on the objections prior to any vote authorizing the acquisition. 32564. (b)Enter into contracts and joint powers agreements with any • public agency, private entity, or person necessary for the proper discharge of the conservancy's duties in furtherance of the purposes set forth in Section 32552. • (c)Lease, rent, sell,exchange, or otherwise transfer any real property or interest therein, or any option ga.leasersessrsally ikercin,.acquired under this division to a local public agency, state agency, federal agency,nonprofit organization, individual; or other entity for management purposes p^-runs+t 'ar+ne ardaar"iti - od-r'y'hp, ranser'aaay in accordance with the purposes set forth in Section 32552. (d) Initiate,negotiate, and participate in any agreement for the management of land under its ownership or control by ^ t^evl rhi+, rn o eery with local public agencies, state agencies,federal agencies,nonprofit organizations,individuals, or other entity, and initiate,negotiate or participate in an agreement for the management of land under the ownership or control of any of those entities by the conservancy,in accordance with the purposes set forth in Section 32552. • (e)Enter into any other agreement with any public agency,private entity, or person necessary for the proper discharge of the • conservancy's duties in accordance with the purposes set forth in Section 32552. • (f)Undertake, within the territory, site improvement projects that provide rcgrilats public access, and revegetate ,restore, and otherwise rehabilitate degraded areas,in consultation with any other public agency with appropriate jurisdiction and expertiser and in accordance with the purposes set forth in Section 32552. The conservancy may also, within the territory,upgrade deteriorating facilities and construct new facilities owned by the conservancy as needed for outdoor recreation,nature appreciation and interpretation, and natural resources protection with the prior writeopprour3^f J+^ m;wb^-notification to the county or city in the jurisdiction in which the conservancy proposes to undertake such activity,in accordance with the purposes set forth in Section 32552. The conservancy shall administer any funds appropriated to it, and may expend those funds for capital improvements,land acquisition, or support of the conservancy's operations in accordance with the purposes set forth in Section 32552. The conservancy may also accept any revenue,money, grants, goods, or services contributed to it by any public agency,private entity, or person and, upon receipt,may expend any such revenue,money, grants, goods, or services for capital improvements, land acquisitions, or support of the conservancy's operations in accordance with the proposes set forth in Section 32552. 32569. (a) The conservancy is a local agency for the purpose of any provision of law authorizing a local agency to borrow money and incur indebtedness. The conservancy may fix and collect fees for the use of any land or facility owned or controlled, or for any service provided,by the conservancy. No fee shall exceed the cost of maintaining and operating the land or facility or of providing the service for which the fee is charged. (b) The fee revenue shall be deposited in the Eastern Los Angeles and San Gabriel Rivers and Mountains Conservancy Fund, which is hereby created in the State Treasury. Nothing in this division shall be interpreted to grant the conservancy any regulatory or governing authority over any ordinance or regulatory measure adopted by a city, county, city and county.or special district that pertains to, including,but not limited to, land use,water rights,or environmental quality. 32571. Notwithstanding any other provision of this division,the conservancy shall not take any action that impedes or adversely impacts any previously adopted Los Angeles County Drainage Act project.
