TRIPEPI, CITY MANAGE)V� DATE: JUNE 15, 1999 _ RE: 3055 DEL MAR AVENUE - HEARING The subject property consists of a tenant-occupied single family dwelling located in the C-3 zone. A "Please Letter" and a "bulky item"trash notice were mailed to the property owners on October 8, 1998_ Inspection on December 1, 1998 revealed only minor progress. The Building Official declared the property substandard and filed a Declaration of Substandard Property with the Los Angeles County Recorder's office On December 8, 1998, a "Fifteen Day" certified letter was mailed and posted on the property, requesting abatement ofthe substandard conditions. On December23, 1998, the building inspector noticed work in progress, although permits had not been obtained. A"Stop Work Notice" was left with the workers at the site. A copy was also mailed to the property owners, Mr. & Mrs. Hsieh. On December 28, 1998, Mr. Hsieh obtained a'•Repair per Rehab" permit. On January 13, 199, another"bulky item" trash notice was sent. On January 28, 1999, interior access was gained and additional defects were noted. A revised list of defects was compiled and mailed to the owners_ An inspection on March I, 1999 revealed that the exterior of the house had been painted, however no access was gained to determine if any interior progress had been achieved. On April 12, and May 13, 1999 additional follow-up inspections were attempted, however no access was gained_ The building inspector left a message for the owners, however no return call was received. A Notice of Hearing was mailed and posted on the property on June 7, 1999. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions be removed and/or corrected by August 2, 1999. Section 9905 of the Code declares all such substandard buildings a public nuisance and requires the abatement thereof by correction, if practical, or demolition of the substandard conditions. As the owner of record, you are hereby notified to comply with the requirements of the above code, and to correct or remove the substandard conditions listed. All such work shall be completed within fifteen (15) days after receipt of this letter. Be advised if you are renting this property to others the City may file a Notice of Non-Compliance with the State Franchise Tax Board. Revenue and Taxation Code Section 17274 states: "No deduction shall be allowed for interest. taxes, depreciation. or amortization_.with respect to substandard (rental) housing." This notice will be posted on the property. If in your opinion,you disagree or cannot comply with the above findings or order, you may request a public hearing.
