WHEREAS, Dennis Tan, 8835 Lynn I ane, Rosemead, California 91770 filed an application to subdivide one lot into two located at 3149 Ivar Avenue, on December 1, 1998; and WHEREAS, 3149 Ivar Avenue, is located in the RA; Single Family Residential zoning district; and WHEREAS, SeAtion 9104 et seq. of the Rosemead Municipal Code (RMC) sets standards for development of properties in the RA Zone; and WHEREAS, Section 66451 et seq. of the California Government Code (Map Act) and Section 9203 of the Rosemead Municipal Code authorize the Planning Commission to approve, conditionally approve or deny tentative parcel maps; and WHEREAS, Sections 66473.5 and 66474 of the California Government Code (Map Act) and 9412 of the Rosemead Municipal Code specify the criteria by which a subdivision may be granted; and WHEREAS, on January 7, 1999, notices were posted in 10 public locations and 72 notices were sent to property owners within a 300-foot radius from the subject property specifying the availability of the environmental analysis, plus the date, lime and location of the public hearing for Tentative Parcel Map 25268; and WHEREAS, on January 18, 1999, the Planning Commission held a duly noticed and advertised public hearing to receive oral and written testimony relative to Tentative Parcel Map 25268; and WHEREAS, the Rosemead Planning Commission has sufficiently considered all testimony presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Rosemead as follows: SF -TTON 1. The Planning Commission HEREBY DETERMLNES that Tentative Parcel Map 25268 is Categorically Exempt from environmental review as a Class 15 Exemption pursuant to Section 15315 of the California Environmental Quality Act (CEQA). This request is to create less than four lots on property with an average slope of less than 20%. Section 15315 exempts such projects that do not change the allowed land use. SECTION 1. The Planning Commission HEREBY FINDS AND DETERMINES that facts do exist to justify approving Tentative Parcel Map 25268 according to the Criteria of Section 9412 of the Rosemead Municipal Code as follows: A. The proposed division will not be materially detrimental to the public welfare not injurious to the property or improvements in the immediate vicinity. kINDING: All necessary utilities and infrastructure is in place to support the proposed development. Any necessary public improvements have been attached as conditions by the Engineering Department. B. The R-1 zone allows single-family homes to be developed at a density of one unit for each 6,000 square feet. Each parcel results in an area of over 6,000 square feet which would allow one single-family home. This proposal has been designed to meet all of the minimum standards for the R-1 zone. C. Each proposed parcel conforms in area and dimension to the provisions of zoning and subdivision requirements of the City of Rosemead. - FINDING: The subdivision will split a single parcel into two lots. The front width will be 71 feet, which exceeds the minimum lot width requirement. The minimum lot area required is to be at least 6,000 square feet and this subdivision creates two lots that are over 6,000 square feet each. D. All streets, alleys and driveways proposed to serve the property have been dedicated or such dedication is not required for the protection of public safety, health and welfare and that such street, alleys and driveways are of sufficient width, design and construction to preserve the public safety and to provide adequate access and circulation for vehicular and pedestrian traffic. FINDING: The site is located on Ivar Avenue, north of Garvey Avenue. Ivar Avenue has good circulation with arrrss from Garvey Avenue to the south. The two lots have been designed to share a driveway. E. Alley easements and covenants required for the approval of the tentative map or plot plan have been duly executed and recorded. FINDING: There are no easements or covenants required for this subdivision. SECTION 1. The Planning Commission HEREBY APPROVES Tentative Parcel Map 25268, subdividing one lot into two for properties located at 3149 Ivar Avenue (APN: 5289-011-032), subject to the conditions listed in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 4. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in Article IX - Planning and Zoning of the Rosemead Municipal Code. SECTION a. ENVIRONMENTAL ASSESSMENT This project consists of the subdivision of a single residential parcel into two lots. Section 15315 of the California Environmental Quality Act (CEQA) exempts projects consisting of the minor land division of four or fewer parcels in areas where the average slope is less than 20% from environmental review. These projects are listed as a Class 15 Categorical Exemption. Therefore, Parcel Map 25268 is a Class 15 Categorical Exemption pursuant to Section 15315 of CEQA. IL MUNICIPAL CODE REQUIREMENTS Section 66474 et seq. of the Subdivision Map Act establishes the criteria for approving a subdivision - - map. In addition, Chapter 9200 of the Rosemead Municipal Code (RMC) provides subdivision regulations which adopts Los Angeles County subdivision regulations by reference. There are five (5)findings that must be made for a tentative map as follows: • The map will not be materially detrimental to the public welfare nor injurious to the property. • The proposed divisions will not be contrary to any official plan_ • Each proposed parcel conforms in area and dimension to city codes. • All streets, alleys and driveways are of sufficient design to provide adequateaccessand circulation for vehicular and pedestrian traffic. • Easement and covenants required for the tentative map have been executed and recorded. Hi. PROPERTY HISTORY AND DESCRIPTION A. BACKGROUND The subject site is located north of Garvey Avenue,west of Ivar Avenue. The site is a 15,386 square feet lot that is currently vacant. Once the lot has been subdivided, construction will begin on two • Tentative Parcel Map 25268 January 18, 1999 Page 2 of 2 new single family homes. The existing parcel is located within a developed residential neighborhood. B. LAND USE 1. Subject Property: On the General Plan Use Policy Map, the subject site is designated Mixed Use: Residential/ Commercial, and on the Zoning Map, this site is designated R-1, Single Family Residential. This designation allows a density of one unit per 6,000 square feet of land. The property is surrounded by the following land uses: 2. ADMINISTRATIVE COMMENTS AND ANALYSTS The applicant is proposing to split the 15,386 square feet residential lot into two parcels. Parcel 1 will total approximately 6,535 sq. ft. Parcel 2 will total approximately 7,100 sq. ft. Construction of two (2)new homes is allowable without approval of a parcel map. The applicant has been issued permits for these two new residences. A three foot planter with irrigation will be located at the southern portion of the driveway leading to the rear lot. The maximum allowable density for the R-I zone is one home per 6,000 sq. ft. of lot area. At this density, the two newly created lots could support a maximum of one home each. Since both homes are below 2,500 square feet, no conditional use permit was required. Staff considers these two new homes vast improvements over the recently demolished older homes. AGENCY COMMENTS The map was distributed to various agencies for their review on December 7, 1998. The agencies made their comments and the City Engineer has checked the parcel map for its accuracy. The City Engineer's conditions of approval have been added to the attached "Exhibit A". The proposed minor subdivision is reasonable and will create two lots that will be designated for single-family ownership. Staff feels that the project meets the criteria for the establishment of a minor subdivision. V. RECOMMENDATION Staff recommends that the Planning Commission APPROVE Tentative Parcel Map 25268 for a period of two (2) years, subject to the conditions outlined in Exhibit"A". EXHIBIT"A" TENTATIVE PARCEL 25268 3149 Ivar Avenue CONDITIONS OF APPROVAL January 18 1999 1. Tentative Parcel 25268 shall be finaled and recorded within two (2) years of tentative approval: Failure to do so may result in the map's expiration and the need for another tentative map application. Any request for extension must be submitted in writing,together within ten(10) copies of the map and corresponding plans to the Planning Department thirty (30) days before the expiration date. 2. Al] conditions of Tentative Parcel Map 25268 must be complied with to the satisfaction of the Director of Planning, prior to final approval of associated maps, building permits, occupancy permits, or any other appropriate request. 3. The conditions listed on this Exhibit"A" shall be copied directly onto any development plans subsequently submitted to the Planning and Building departments for review. 4. Prior to issuance of building permits, any revisions to the approved plans must be resubmitted for review and approval by the Planning Department. 5. Approval shall not take effect for any purpose until the applicant has filed with the City of Rosemead an affidavit stating that he/she is aware of and accepts all of the conditions set forth in the letter of approval and this list of conditions. An affidavit accepting these conditions shall be submitted to the Planning Department within ten (10) days of approval. 6. The applicant shall comply with all Federal, State and local laws relative to the approved use including the requirements of the Planning, Building, Fire, Sheriff and Health Departments. 7. All trash, rubbish and garbage receptacles shall be regularly cleaned, and inspected and maintained in a clean, safe and sanitary condition. 8. The site shall be maintained in a clean, weed, litter-free state in accordance with Section 5401-5405 of the Rosemead Municipal Code (RMC), which pertains to the storage, accumulation, collection, and disposal of garbage, rubbish, trash, and debris. All trash containers shall be stored in the appropriate trash enclosure at all times. My new litter and graffiti shall be removed within twenty-four (24) hours. A 24-hour, Graffiti Hotline can be called at (626) 307-0463 for assistance. 9. No portion of any required front and/or side yards shall b used for storage of any type. 10. The perimeter property lines of the newly created lot, or where designated by the Directory of Planning, shall be fenced with a six-foot (6) high masonry wall with finished surface on both sides, or wooden fence, supported by steel posts in concrete. 11. Driveways and parking areas shall be surfaced and improved with Portland concrete cement of asphaltic concrete, and thereafter maintained in good serviceable condition. 12. The project shall comply with the conditions set forth in the City Engineer's report (which is attached)and the Fire Department's recommendation. These conditions shall be completed to the City Engineer's satisfaction prior to recordation of the final map. 13. The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/4", contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 14. Applicant shall obtain a public works permit for all work in or adjacent to the public right-of- way. 15. Applicant shall install and complete all necessary public improvements, including but not limited street, curbs, gutters, sidewalks, handicap ramps, and storm drains along the entire street frontage of the development site as required by the Director of Planning. 16. All required yard and common areas shall be landscaped with turf; trees, and shrubs and shall be maintained as necessary. 17. The applicant shall install approved street trees in a location chosen by and to the satisfaction of the Engineering Department. In addition, at least one 15-gallon tree shall be provided on each newly lot subject to the approval of the Director of Planning. 18. No trees shall be removed other than those down on the approved plans. 19. The property shall be kept cleared of weeds, debris, and abandoned vehicles maintained pursuant to the County Fire and Health codes until it is developed. All trash shall be contained in trash bins and removed on an as-needed basis. No trash shall be visible from outside the trash bin. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. 20. All utilities shall be placed underground including facilities and wires for the supply and distribution of electrical energy,telephone, cable telephone, etc. The underground conversion of these utilities shall consider all future connections to the satisfaction of the Director of Planning. 21. Prior to issuance of building permits, the applicant shall submit landscaping/irrigation plans as noted in the staff report, subject to review and approval from the Planning Department. A permanent maintenance program of all landscaping shall be provided insuring regular irrigation, fertilization and weed abatement. Landscape materials and irrigation system tare to be inspired by a City representative prior to final occupancy. 22. Violation of the conditions of approval may result in citation and/or initiation of revocation proceedings. CITY ENGINEER'S CONDITIONS OF APPROVAL FOR TENTATIVE PARCEL MAP NO. 25268 January 18, 1999 GENERAL 1. Details shown on the tentative map are not necessarily approved. Any details which are inconsistent with requirements of ordinances, general conditions of approval, or City Engineer's policies must be specifically approved in the final map or improvement plan approvals. 2. A final parcel map prepared by, or under the direction of a Registered Civil Engineer authorized to practice land surveying, or a Licensed Land Surveyor, must be processed throueh the City Engineer's office prior to being filed with the County Recorder. 3. A preliminary subdivision guarantee is required showing all fee interest holders and encumbrances. An updated title report shall be provided before the final parcel map is released for filing with the County Recorder. 4. Monumentation of parcel map boundaries, street centerline and lot boundaries is required for a map based on a field survey. 5. Final parcel map shall be filed with the County Recorder and one(1) mylar copy of filed map shall be submitted to the City Engineer's office prior to issuance of building permits. 6. Comply with all requirements of the Subdivision Map Act. 7. Approval for filing of this land division is contingent upon approval of plans and specifications mentioned below. If the improvements are not installed prior to the filing of this division, the developer must submit an Undertaking Agreement and a Faithful Performance and Labor and Materials Bond in the amount estimated by the City Engineer guaranteeing the installation of the improvements. 8. The City reserves the right to impose any new plan check and/or permit fees approved by City Council subsequent to tentative approval of this map. DRAINAGE AND GRADING • 9. Prior to the recordation of the final map, grading and drainage plans must be approved to provide for contributory drainage from adjoining properties as approved by the City Engineer, including dedication of the necessary easements. 10. A grading and drainage plan must provide for each lot having an independent drainage system to the public street, to a public drainage facility, or by means of an approved drainage easement. 11. Historical or existing storm water flow from adjacent lots must be received and directed by gravity to the street, a public drainage facility, or an approved drainage easement. ROAD 12. Developer shall grant a 1'wide road deed dedication along the property frontage. SEWER 13. Approval of this land division is contingent upon providing separate house sewer laterals to serve each lot of the land division. UTILITIES 14. Power, telephone and cable television service shall be underground. 15. Any utilities that are in conflict with the development shall be relocated at the developer's expense. WATER 16.
