REHAB – Approval of Minutes 06-24-97 MINUTES OF THE REGULAR MEETING ROSEMEAD BUILDING REHABILITATION APPEALS BOARD JUNE 24, 1997 The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order by Chairman Imperial at 7:13 p.m. in the Conference Room of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag and Invocation were waived as having been completed during the meeting just adjourned. ROLL CALL OF OFFICERS: Present: Boardmembers Clark, Taylor, Vasquez, Vice-Chairman Bruesch, and Chairman Imperial Absent: None APPROVAL OF MINUTES: MAY 27, 1997 -REGULAR MEETING MOTION BY VICE-CHAIRMAN BRUESCH, SECOND BY BOARDMEMBER TAYLOR that the Minutes of the Regular Meeting of June 24, 1997, be approved as submitted. Vote resulted: Aye: Bruesch, Vasquez, Imperial, Clark, Taylor No: None Absent: None Abstain: None The Chairman declared said motion duly carried and so ordered. I. ADMINISTRATION OF OATH The Board Secretary administered the oath to all persons wishing to address the Board. H. HEARINGS A. 2512 MUSCATEL AVENUE-REHEARING The subject property consists of a vacant single family residence with an unpermitted garage conversion and storage room. This property was previously before the Board on May 27, 1997. At that time, the Board ordered the case returned for rehearing and directed staff to meet with the owners on site to discuss all the substandard conditions. Inspection was scheduled for June 4, 1997. On that date, the Supervising Building Inspector and the Building Inspector met with Mrs. Figueroa, the property owner, and her husband. Interior access was gained and a revised list of defects was generated. All items were reviewed and explained. The Figueroas indicated that it would be difficult for them to comply, or obtain permits, due to financial constraints. A Notice of Hearing, with the amended list of defects, was mailed and posted on the property on June 9, 1997. All interested parties have been notified. The City Building Official recommended that the Board find the property substandard and order all substandard conditions removed and/or corrected by August 1, 1997. Mr. and Mrs. Figueroa, 4683 Howard Street, Montclair were present to answer any questions. REHAB 6-24-97 Page #1 Vice-Chairman Bruesch asked if the buildings in the back were used as rentals at the time of purchase and have they been occupied through the years since. Mrs. Figueroa stated that a relative has lived there on occasion, but the building has never been rented. Vice-Chairman Bruesch requested that the plumbing be removed Mr. Figueroa stated that the toilets have been removed. Steve Bailey, Building Inspector, stated that they normally require the plumbing be removed back to the source so that they cannot be easily re-installed. Vice-Chairman Bruesch questioned the deteriorated fencing and the trash and debris stored throughout the yard areas. Mr. Figueroa responded that the fence belongs to their neighbor who is uncooperative and wants to leave the fence as is. Mr. Figueroa stated that the trash and debris is left there by the tenants of the front property. Mr. Bailey stated that as inspection today, no repairs have been made. B. 2625-25 1/2 MUSCATEL AVENUE The subject property consists of a tenant-occupied single family residence and an unpermitted unoccupied garage conversion. The property is zoned R-1. A'Please Letter" was mailed to the property owner on September 11, 1996. On September 16, 1996, Mr. Figueroa, the property owner, came to City Hall to discuss the list of defects. He requested inspection for the following day. The building inspector attempted inspection, however, Mr. Figueroa was not there and no interior access was gained. It was noted that work was in progress without permits. A "bulky item" trash notice was sent to both the owner and tenants on October 7, 1996. A follow- up inspection on October 16, 1996 revealed no change. The Building Official declared the property substandard and filed a Declaration of Substandard Property with the Los Angeles County Recorders office. A "Thirty Day" certified letter was mailed and posted on the property on October 24, 1996, requesting abatement of the substandard conditions. On November 26, 1996, Mr. Figueroa again came to City Hall. He discussed the garage conversion with both Building and Planning Departments. He was advised that the lot is too small to accommodate two units. Mr. Figueroa requested additional time to complete the work. He was told that the extension would be based upon progress. An inspection appointment was made for later that day. When the inspector arrived, Mr. Figueroa had no keys to the units. Only minor exterior progress was noted. Inspection on January 2, 1997, revealed no change in the condition of the property. On January 8, 1997, a second "bulky item" trash letter was mailed. Follow-up inspections on February 5, and March 6, 1997 revealed no progress. On March 7, 1997, telephone contact was made with Mr. Figueroa. He state he would obtain permits and make progress by the following week. A third trash notice was sent on March 25, 1997. Inspection on March 27, 1997 again REHAB 6-24-97 Page#2 revealed no progress. The Building Inspector spoke with Mr. Figueroa by phone on April 15, 1997. He stated he would come in that day or the following day to obtain permits. On April 21, 1997, a letter was sent to Mr. Figueroa regarding the garage conversion. No response was received. Inspection on May 13, 1997 showed no change. Another inspection was made on June 4, 1997. Interior access was gained and a revised list of defects was generated. All items were reviewed and explained. The Figueroas indicated that it would be difficult for them to comply, or obtain permits, due to financial constraints. Ivlr. and Mrs. Figueroa, 4683 Howard, Montclair, own this property also. Vice-Chairman Bmesch asked the owner how long they have owned this property, were the homes occupied as rentals at that time, and were they aware of the illegal garage conversion? Mrs. Figueroa responded that they purchased the property 9 years ago as rentals and were not aware of any illegalities. C. 9229 PITKIN STREET- REHEARING The subject property consists of a vacant duplex located in the R-1 zone. This property has been through the Property Rehabilitation Program in the past, and was recently before the Appeals Board on April 22, 1997. At that time, the Board ordered a completion date of June 2, with a possible extension to July I, 1997, if sufficient progress was achieved. At the meeting, the property owner,Mr. Steve Moreno, agreed to an inspection appointment for 9:00 a.m. on May 19, 1997 to provide interior access. On that date, Mr. Moreno's representative phoned to cancel the appointment due to family illness. The inspection was rescheduled, and the Supervising Building Inspector met with Mr. Moreno on May 27, 1997. Interior access was gained, with the exception of the garage, and a revised lists of defects was generated. The amended list was reviewed with Mr. Moreno. A copy was mailed and posted on the property on June 3, 1997. At the May 27, 1997 meeting, the Board requested this case be returned to review the updated list of defects and to clarify Mr. Moreno's intentions regarding the property. A Notice of Hearing was mailed and posted on the property on June 9, 1997. MI interested parties have been notified. The City Building Official recommends that the Board find the property substandard and order all substandard conditions removed and/or corrected by August 1, 1997. The buildings shall remain secure against unlawful entry until they are demolished or repaired and occupied. This is a final Board Order, and not to be returned for Rehearing.
