REHAB – Approval of Minutes 07-22-97 NOT OFFICIAL UNTIL APPROVED BY THE ROSEMEAD REHABILITATION APPEALS BOARD MINUTES OF THE REGULAR MEETING ROSEMEAD BUILDING REHABILITATION APPEALS BOARD JULY 22, 1997 The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order by Chairman Imperial at 7:07 p.m. in the Conference Room of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag and Invocation were waived as having been completed during the meeting just adjourned. ROLL CALL OF OFFICERS: Present: Boardmembers Clark, Taylor, Vasquez, Vice-Chairman Bruesch, and Chairman Imperial Absent: None APPROVAL OF MINUTES: JUNE 24, 1997 -REGULAR MEETING MOTION BY BOARDMEMBER BRUESCH, SECOND BY BOARDMEMBER TAYLOR that the Minutes of the Regular Meeting of June 24, 1997, be approved as submitted. ADMINISTRATION OF OATH The Board Secretary administered the oath to all persons wishing to address the Board. H. HEARINGS A. 7847 DOROTHY STREET - REHEARING The subject property consists of a vacant single family residence located in the R-2 zone. A "Please Letter" was mailed to the property owner on October 28, 1996. Inspection on November 27, 1996 revealed no progress. The Building Official declared the property substandard and filed a Declaration of Substandard Property with the Los Angeles County Recorder's office. A "Thirty Day" certified letter was mailed and posted on the property on December 12, 1996, requesting abatement of the substandard conditions. The letter was returned "unclaimed" and was sent again by first class mail. A progress inspection on January 15, 1997 showed no change. Inspection on February 14, 1997 found the garage to be open and accessible. The building inspector attempted to phone the owner, who resides in Utah, but no number is listed with telephone company information. On February 19, 1997, a "Notice of Intent to Barricade" was mailed and posted on the property. No response was received. Interstate Field Services barricaded the building on March 3, 1997. A "Notice of Cost" was sent to the owner on March 10, 1997. Progress inspections in March, April, May and June 1997 showed the property to be secure, however all items on the list of defects remain. In addition to the original deficiencies, the property now contains overgrown weeds and vegetation. Staff has received no response or had any contact with the owner since the initiation of the case. On July 1, 1997, a special assessment was filed against the property for the barricading costs incurred. REHAB 7-22-97 Page 41 A Notice of Hearing was mailed and posted on the property on July 8, 1997. All interested parties have been notified. The Building Official recommends that the Board find the property substandard and order all substandard conditions removed and/or corrected by September 2, 1997. Brian Jury, 7853 Dorothy Street, representing his grandmother and himself, stated that they are neighbors of the abandoned property. Mr. Jury confirmed that the owner resides in Utah and that the property has been an on-going problem for the past two years. The property is overgrown with weeds and he is concerned that it is a fire hazard. Chairman Imperial suggested contacting the city where the owner lives in an attempt to locate the owner. Robert Kress, City Attorney, stated that computer checks will be run also. James Guerra, Building Official, recommended modifying the recommendation to include obtaining a Court Order for a 10-day Weed Abatement Warrant and the City can then start the weed abatement process. MOTION BY VICE-CHAIRMAN BRUESCH, SECOND BY BOARDMEMBER TAYLOR that the Board direct staff to obtain the 10-day Weed Abatement Court Order, continue efforts to locate the owner, find the property substandard and order all substandard conditions removed and/or corrected by September 2, 1997. B. 3027-3029 EARLE AVENUE - REHEARING The subject property consists of three, tenant-occupied units located in the M-1 zone. The only remaining substandard condition is the carport attached to the rear garages that was constructed without permits. This property was previously before the Board on May 27, 1997. At that time, Ms. Hwang indicated she still wanted a carport. She agreed to demolish the substandard structure, and to submit plans and obtain permits and approvals for a complying carport. The Board ordered the case deferred, and to be returned for Rehearing in July. After the initial Hearing, Ms. Hwang submitted another letter, dated June 6, 1997, again asking that the substandard structure be allowed to remain. The letter also contains various accusations towards staff. On June 10, 1997, Mr. Steve Bailey, Supervising Building Inspector, responded to Ms. Hwang's letter To date, no plans have been submitted and no permits have been issued. A Notice of Rehearing was mailed and posted on the property on July 8, 1997. All interested parties have been notified. The Building Official recommends that the Board find the property substandard and order all substandard conditions removed and/or corrected by September 2, 1997. STATUS REPORTS A. SUBSTANDARD BUILDINGS AND PROPERTIES Vice-Chairman Bruesch requested an update on 4623 Earle. Mr. Guerra responded that a second Special Assessment has been filed. Vice-Chairman Bruesch requested a Title Report on that property in order to ascertain whether property taxes have been paid and by whom. B.
