A. Short -Term Rental of Residential Homes and Boarding Houses — Municipal Code
Amendment 18-02
The Rosemead Zoning Code (Title 17) of the Rosemead Municipal Code carries
out the policies of the Rosemead General Plan by classifying and regulating uses
of land and structures within the City. The Zoning Code, however, is silent on
short-term rental of residential homes and boarding houses, and as such the uses
are not currently regulated for land use. The proposed Municipal Code Amendment
would amend the Rosemead Zoning Code by adding definitions for `Boarding
house or rooming house" and "Short-term rental," and prohibit boarding/rooming
house and short-term rental of residential homes in the residential zones (R-1, R-2,
and R-3). The proposed Code Amendment would not affect residential rental (e.g.,
home, duplex, triplex, apartments, etc.) with a lease or rental agreement that is not
short-term.
Recommendation: That the City Council take the following actions:
1. Conduct a public hearing and receive public testimony; and
2. Introduce for first reading, by title only, Ordinance No. 980
approving Municipal Code Amendment 18-02.

B. Sidewalk Gap Closure Project (Delta Avenue from Mission Drive to Wells Street)
Award of Contract for Design Engineering
As part of the City's Fiscal Year 2018-19 Capital Improvement Program, the City
Council approved a project entitled "SR2S Sidewalk Gap Closure — Delta Avenue"
which consists of public improvements to the City's local streets and public right-
of-way areas. In compliance with the American with Disabilities Act (ADA)
guidelines, this project consists of adding and retrofitting concrete sidewalk
including the installation of parkway trees and appurtenances. The proposed work
will take place on Delta Avenue between Mission Drive and Wells Street. This
project is not only going to beautify the area; but also, it will create a continuous
sidewalk on both sides of Delta Avenue. These improvements will help pedestrians
and school children that sometimes walk on the street due to the lack of continuous
sidewalk on these streets.
Recommendation: That the City Council authorize the City Manager to enter into
a contract with CEJ Engineers, Inc. in the amount of $38,380 for design engineering
services. In addition, authorize an amount of $4,000 (approximately 10%) as a
contingency to cover the cost of unforeseen expenses.
C. HOME Investment Partnerships Funds Commitment Agreement Between the City
of Rosemead and The Rosemead Housing Development Corporation for the

Implementation of Certain Home Funded Programs
The City is required to commit its HOME Investment Partnerships (HOME) funds
for particular affordable housing activities within 24 months after the U.S.
Department of Housing and Urban Development's (HUD's) appropriation of the
entitlement allocation. To comply with this requirement, staff recommends that the
City commit $258,128 of FY 2018-19 HOME funds, plus unspent carried over
funds of approximately $510,500 from prior FY's, by contracting with the
Rosemead Housing Development Corporation (RHDC) to administer certain
HOME funded programs.
Recommendation: That the City Council and the Rosemead Housing Development
Corporation take the following actions:
1. Approve a HOME Funds Commitment Agreement between the City
Council and the RHDC for the implementation of the City's Owner -
Occupied Rehabilitation Loan Program in the amount of $578,628
(approximately) and Mortgage Assistance Program in the amount of
$190,000;
2. Authorize the Mayor to execute the contract on behalf of the City; and
3. Authorize the President to execute the contract on behalf of the RHDC.
D. School Resource Officer Program Funding
The City currently contracts with the Los Angeles County Sheriff's Department for
a Special Assignment Deputy that is assigned to Rosemead High School as a School
Resource Officer (SRO). The El Monte Union High School District currently
shares the cost of the SRO with the City for the hours that the SRO is assigned to
the School; however, the agreement must be renewed by both the City and the
School District. City staff has included the necessary funding in the 2018/19
Budget to cover the City's portion of the agreement.
Recommendation: That the City Council approve the agreement with the El Monte
Union High School District for assistance in funding the SRO position in the
amount of $102,300.
E. Retroactive Payments for Changes in FLSA Regulations
On June 2, 2016, the Ninth Circuit Court of Appeals issued their decision for the
Flores v. City of San Gabriel case. The City of San Gabriel tried to appeal the case
ruling and was denied the petition on May 2017. Thus, new interpretation of law
was established in which employers are now required to include cash -in -lieu of
health coverage payments in the regular rate of pay for the calculation of overtime
in accordance with the Fair Labor Standards Act (FLSA) regulations.
Recommendation: That the City Council take the following actions:

1. Make back payments to impacted employees from July 1, 2014 to current; and
2. Approve Resolution No. 2018-35 approving the appropriation from the
unassigned General Fund Balance of $40,000 for retroactive payments to
employees for changes in FLSA regulations:

F. Annual Crossing Guard Cost Sharing Agreements with the School District
The existing agreement with All City Management Services, Inc., (ACMS) for
crossing guard services near local public schools is effective through June 30, 2019.
However, the annual cost sharing agreements with the Rosemead School District
and the Garvey School District for crossing guard services will end on June 30,
2018. The new annual agreements for FY 2018/19 with each school district totals
$82,593.00. The funds are contained in the City's proposed 2018/19 Fiscal Year
Budget.
Recommendation: That the City Council authorize the City Manager to execute the
cost sharing agreements with Rosemead School District and the Garvey School
District in funding the crossing guard services for the 2018/19 Fiscal Year.
6. MATTERS FROM CITY MANAGER & STAFF
A. LASD Annual Service Level Authorization
The City contracts with the Los Angeles County Sheriff's Department for police
services. Each year the City must re -authorize the Service Level Authorization for
the deployment contracted by the City. The enclosed 2018-2019 Service Level
Authorization maintains the existing service levels of 12 56 -hour patrol shifts, 7
special assignment deputies, 2 motor deputies, a Sergeant and a Lieutenant. It
should be noted that the Lieutenant position is not listed on the authorization form
as the position is not directly billed to the City as an itemized cost. The estimated
costs include a 3% increase in cost, plus an increase in the Liability Trust Fund
from 10% to 10.5%.
In addition, staff is also including the 2017-2018 Service Level Authorization, the
estimated costs include a 3.7% increase in cost, plus an increase in the Liability
Trust Fund from 9.5% to 10%. This document was executed on October 1, 2017.
Recommendation: That the City Council approve the Service Level Authorization
Forms with the Los Angeles County Sheriff's Department for police services and
authorize the City Manager to sign any necessary documentation.

B. Los Angeles County Probation Department Annual Contract Renewal — Los
Angeles County Sheriff's Department (STAR) Program
The City currently contracts with the Los Angeles County Probation Department
for one Deputy Probation Officer (DPO). The DPO's main duties are juvenile
prevention and intervention programs. The DPO works full-time with Rosemead
youth who have been identified as at -risk or arrested for minor criminal offenses.
These juveniles may have problems ranging from school performance and
attendance to vandalism, theft, and drug arrests. The DPO works closely with the
schools, juveniles and their families to implement a variety of programs and
services to assist in correcting their behavior. The DPO position has been a part of
the City's effort and strategy in providing overall public safety.
In previous years, the City had contracted with the Los Angeles County Sheriff's
Department's to provide the Success Through Awareness & Resistance (STAR)
program. The unit is comprised of Deputy Sheriffs who provide drug, gang, and
violence prevention education to students. The program they provide is a structured
curriculum consisting of a number of classes and lessons agreed upon. The number
of lessons provided influences the overall price. A sample cost estimate is provided
as a measuring tool to compare the number of lessons for grade levels based on the
number of schools in both the Rosemead and Garvey School Districts.
Recommendation: That the City Council authorize the City Manager to take the
following actions:
Execute the Los Angeles County Probation Department Agreement with the
understanding that the Agreement could be terminated with 30 days written
notice;
2. Direct staff to work with the STAR program representatives to determine an
effective program within a determined approximate amount or range; and
3. Direct staff to bring back a formal agreement for the STAR program reflecting
an agreed upon curriculum and within the approximate amount or range.
