DATE: AUGUST 28, 2018 SUBJECT: ELECTRICAL VEHICLE CHARGING STATION LOCATIONS AND RESTRICTIONS AT CITY OWNED PARKING FACILITIES California Vehicle Code Section 22511 allows a local authority to designate stalls or spaces in off street parking facilities owned by that authority (City) for the exclusive purpose of charging and parking a vehicle that is connected for electric charging purposes. It also allows the local authority to cite and remove a vehicle from an electric vehicle charging station if the local authority has posted appropriate signage stating that certain spaces are designated for electric vehicle charging purposes only. DISCUSSION The City currently has electric vehicle charging stations at two City owned parking facilities. There are two stations that serve four vehicle stalls located at the Civic Center Plaza parking area between City Hall and the Rosemead Community Recreation Center, and two stations that serve four vehicle stalls at the Garvey Community Center parking area. For the City to properly designate, install signage, and enforce parking restrictions for the electrical vehicle station stalls, the City must formerly identify the locations being designated exclusively for electric vehicle charging stations. The attached Resolution meets this requirement. STAFF RECOMMENDATION It is recommended that the City Council adopt and approve Resolution No. 2018-49. Resolution No. 2018-49 Attachment A Resolution 2018-49 RESOLUTION NO. 2018-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ESTABLISHING PARKING SPACE LOCATIONS AND RESTRICTIONS FOR ELECTRIC VEHICLE CHARGING STATIONS AT THE CITY OWNED PARKING FACILITIES LOCATED AT 8838 EAST VALLEY BOULEVARD, 3936 NORTH MUSCATEL AVENUE AND 9108 GARVEY AVENUE IN THE CITY OF ROSEMEAD WHEREAS, California Vehicle Code Section 22511 (a)(1) allows a local authority to designate stalls or spaces in off street parking facilities owned or operated by that local authority for the exclusive purpose of charging and parking a vehicle that is connected for electric charging purposes; and WHEREAS, California Vehicle Code Section 22511 (c)(1) allows a local authority to cause the removal of a vehicle from a space with an electric vehicle charging station if the local authority has posted appropriate signs and notified the police or sheriffs department; and WHEREAS, the City has already constructed several parking spaces with electric vehicle charging stations at City owned parking facilities; and WHEREAS, the City anticipates constructing additional parking spaces with electric vehicle charging stations at all City owned parking facilities; and WHEREAS, the City desires to designate parking spaces in City owned parking facilities with electric vehicle charging stations exclusively for the purpose of charging and parking a vehicle that is connected for electric charging. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. The stalls with electric vehicle charging stations in the City owned parking facilities located at 8838 East Valley Boulevard, 3936 North Muscatel Avenue, and 9108 Garvey Avenue are designated for the exclusive parking of electric vehicles that are connected to electric vehicle charging stations for the purpose of transfer of electricity to the battery or other energy storage device of an electric vehicle. SECTION 2. The Department of Public Works is authorized to place signs or markings giving adequate notice that the parking space or spaces are restricted and to be used only for such electric vehicles. The signs or markings shall be in compliance with California Vehicle Code § 22511 indicating that vehicles left standing in violation of the restriction may be removed. The parking restriction shall not apply to the designated parking spaces until the sign or markings have been placed. SECTION 3. Where a sign designating a parking space for the exclusive use of charging electric vehicles is posted, no person shall park in that space any nonelectric vehicle, electric vehicle that isnot connected to the electric vehicle charging station, electric vehicle that is not charging, or electric vehicle that has been charging for more than four hours. All vehicles towed pursuant to this Section may be towed away at the vehicle owner's expense. SECTION 4. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect. PASSED, APPROVED, AND ADOPTED this 28"' day of August, 2018.
