MATTERS FROM MAYOR & CITY COUNCIL A. Consideration of an New Urgency Ordinance Temporarily Prohibiting Eviction of Residential and Commercial Tenants Arising from Financial IMPACTS OF THE covid-19 Pandemic in Response to the Governor’s March 27th Order At the March 24, 2020 regular council meeting, the City Council adopted Ordinance No. 993 temporarily prohibiting evictions of residential and commercial tenants arising from financial impacts of the COVID-19 Pandemic. On March 27, 2020, Governor Newsom issued Executive Order N-37-20, which created certain Public Comment from the Audience  If you wish to address the City Council, please complete a Speaker Request Card, as it must be handed to the City Clerk before the start of the meeting.  The City Council will hear public comments on matters not listed on the agenda during the Public Comments from the Audience period.  Opportunity to address the City Council (on non-agenda items) is limited to 3 minutes per speaker.  The City Council will hear public comments on items listed on the agenda during discussion of the matter and prior to a vote. Brown Act Pursuant to provisions of the Brown Act, no action may be taken on a matter unless it is listed on the agenda, or unless certain emergency or special circumstances exist. The City Council may direct staff to investigate and/or schedule certain matters for consideration at a future City Council meeting. Rules of Decorum Persons attending the meeting shall observe rules of propriety, decorum, good conduct, and refrain from impertinent or slanderous remarks. Violation of this rule shall result in such persons being barred from further audience before the governing body. Pursuant to Gov. Code Sect. 54954.3(c), any person who engages in unlawful interference shall be removed from chambers. Americans with Disabilities Act In compliance with the ADA, if you need special assistance to participate in this meeting, please contact the City Clerk’s office at least 48 hours prior to the meeting to allow the City to make reasonable arrangements to ensure accessibility to the meeting or service. Any writings or documents provided to a majority of the Rosemead City Council regarding any item on this agenda will be made available for public inspection in the City Clerk’s office during normal business hours. 3 Rosemead City Council Special Meeting Agenda March 30, 2020 protections against eviction for residential tenants, but such Order did not address commercial tenants, nor did it provide as much protection for residential tenants as the County’s March 19, 2020 Order, or the City’s, nor did it preclude adoption by local entities of protections that are greater than those set for in the Governor’s order. In order to keep in place the protections afforded in Ordinance No. 993, as well as to clarify that the protections enacted by the Council on March 24, 2020 in Ordinance No. 993 are not eliminated by the Governor’s March 27, 2020 Executive Order, adoption of an urgency ordinance is required. Ordinance No. 994 shall take effect immediately upon adoption by a 4/5 vote of the City Council, due to the immediate need to protect the public health, safety and welfare. Recommendation: That the City Council take the following actions: 1. Find that the recommended action is exempt from the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines per Section 15061 (b)(3), the General Rule that CEQA only applies to projects that may have an affection to the environment; and 2. Adopt by a 4/5 vote Urgency Ordinance No. 994, entitled: AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD TEMPORARILY PROHIBITING EVICTIONS OF RESIDENTIAL AND COMMERCIAL TENANTS ARISING FROM INCOME LOSS OR SUBSTANTIAL MEDICAL EXPENSES RELATED TO THE COVID-19 PANDEMIC B. Authorization of Agents to Execute on the Behalf of the City for the Purpose of Obtaining State and Federal Financial Assistance Through Emergency Management Assistance Program The City Council will consider adoption of a Resolution appointing and authorizing City officials to take actions on behalf of the City to obtain financial assistance from State and Federal agencies for emergency preparedness and disaster relief. Recommendation: The City Council City Council approve Resolution 2020-10, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPOINTING AND APPROVING AUTHORIZED AGENTS TO EXECUTE FOR AND ON BEHALF OF THE CITY OF ROSEMEAD FOR THE PURPOSES OF OBTAINING STATE AND FEDERAL FINANCIAL ASSISTANCE THROUGH EMERGENCY MANAGEMENT ASSISTANCE PROGRAMS AND AUTHORIZING THE CITY MANAGER TO EXECUTE AND FILE THE CAL 4 Rosemead City Council Special Meeting Agenda March 30, 2020 OES FORM 130 AND SUBMIT ALL RELATED DOCUMENTATION 4. MATTERS FROM MAYOR & CITY COUNCIL A. Mayor’s Appointments for 2020-2021 Each year, a listing of City Council Member appointments to a variety of Regional and State committees and boards is prepared and submitted to the Mayor. Once the appointments have been made, the City Clerk’s office will prepare Form 806 as required by the Fair Political Practices Commission (FPPC), immediately file the form with the FPPC, and post it on the City’s website. Recommendation: That the City Council discuss and approve the Mayor’s Appointments for 2020-2021 and direct the City Clerk to prepare and file Form 806. 5. ADJOURNMENT The next regular City Council meeting is scheduled for April 14, 2020, at 7:00 p.m. in the Rosemead City Hall Council Chamber.
