DATE: JUNE 9, 2020 SUBJECT: GARVEY PARK GYM COOLING SYSTEM (HVAC) PROJECT NO. 31019 — AWARD OF CONTRACT SUMMARY The Garvey Park Gym Cooling Project was approved by the Council as part of the FY 2019-20 adopted budget and included in the Capital Improvement Program (CIP) and the Annual Action Plan for CDBG activities. The Notice Inviting Bids (NIB) for this project were published on February 27, 2020 and March 5, 2020 with a March 18, 2020 submission deadline. Two bids were received and after reviewing for responsiveness it was determined that one bid did not meet SB 854 requirements (a subcontractor was not registered with the State Department of Industrial Relations for Public Works), and second bid was significantly over the City Engineer's estimated project cost. The two bids were presented to the Council on April 14, 2020, and both bids were rejected and the project to be readvertise. Project was rebid by publishing NIBS on April 23, 2020 and April 30, 2020 with a submission deadline of May 14, 2020. One bid was received, reviewed, and has been determined to be responsive. DISCUSSION The Garvey Park Gym Cooling Project consists of the installation of cooling addition of the existing Garvey Park Gym building located at 7933 Emerson Place, Rosemead, CA 91770 and consists of new cooling system, electrical, fixtures, framing, and landscaping. Thomas Air Conditioning is one of the two prior contractors that submitted a bid on March 18, 2020 but rejected because a subcontractor was not registered with the State Department of Industrial Relations (DIR) for Public Works project. After careful review of rebid submitted on May 14, 2020, F.M. Thomas Air Conditioning has subsequently been determined to be compliant with the subconsultant (Scott Manfredi) now registered and in good standing. This was the only finding when initial bid was received in March and since then it has been rectified. The project will be funded with Community Development Block Grant (CDBG) allocation from the Department of Housing and Urban Development (HUD). The project's construction budget is $338,800 in the FY19-20 and FY 20-21 Annual Action Plans. Installation of the cooling system will allow for the City to provide our residents a safer and more comfortable recreational environment, prevent fatigue and headaches that can come from overexertion in a hot environment, and allow the City to better program and expand summer activities. STAFF RECOMMENDATION It is recommended that the City Council: Approve a contract award to F.M. Thomas Air Conditioning; and 2. Authorize the City Manager to enter into a contract with F.M. Thomas Air Conditioning, for the based bid amount of $332,725 for the gym cooling. In addition, authorize an amount of $33,272 (10%) as a contingency to cover the cost of unforeseen construction expense, for a total amount of $365,997. FINANCIAL IMPACT CDBG funding for this project is included in the Fiscal Year 2019-2020 Capital Improvement Program (CIP). Additional CDBG funding will be included in the Fiscal Year 2020-2021 CIP budget for a total construction budget of $338,800. ENVIRONMENTAL REVIEW Since the proposed work involves the rehabilitation of an existing public facility, the project is Class 1 Categorically Exempt pursuant to the California Environmental Quality Act (CEQA). STRATEGIC PLAN IMPACT The project is consistent with the Strategic Plan's guiding principal for fiduciary responsibility of providing for transparency in financial management of City's finances and providing quality of life enhancement. On March 18, 2020, bids were received and reviewed for the project. DISCUSSION On March 18, 2020, the City Clerk received two (2) sealed bid with the following result: Contractor Location Base Bid Amount Add Alt. 1 Add Alt.2 F.M. Thomas Air Conditioning proposal includes a subconsultant (Scott Manfredi Construction, inc.) that is not registered with the Department of Industrial Relations (DIR) and is therefore rejected as not responsive. Staff believes that by rebidding the project and reaching out to several other contractors, additional bids will be received ensuring the most competitive pricing. STAFF RECOMMENDATION It is recommended that the City Council: 1. Reject all bids received for this project and direct staff to readvertise the project for new bids; and 2. Take such additional, related action that may be desirable. AGENDA ITEM 4.E City Council Meeting April 14, 2020 Page 2 of 2 FINANCIAL IMPACT CDBG funding for this project is included in the Fiscal Year 2019-20 Capital Improvement Program (CIP). Additional funding will be included in the Fiscal Year 2020-21 CIP budget to total approximately $338,000 in CDBG funds. Rejecting all bids and readvertising the project would ensure that the City receives the most competitive bid for the project. STRATEGIC PLAN IMPACT Rejection of all bids and readvertising the project is consistent with the Strategic Plan's guiding principal for fiduciary responsibility of providing for transparency in financial management of City's finances.
