No. 97-05 - Awarding the Bid for the 1995-96 and 1996-97 Concerte Repair Project RESOLUTION NO. 97-05 A RESOLUTION OF THE ROSEMEAD REDEVELOPMENT AGENCY AWARDING THE BID FOR THE 1995-96 AND 1996-97 CONCRETE REPAIR PROJECT The Rosemead Redevelopment Agency hereby resolves as follows: SECTION 1. The Redevelopment Agency fmds, determines and declares: A. The Redevelopment Agency, in a joint project with the City of Rosemead, recently advertised for and received bids for the 1995-96 and 1996-97 concrete repair project; and B. Fifteen bids were received and opened on January*15, 1997, with the following three lowest bidders: Kukbo Construction $93,444.00 Robinson's Construction $94,312.40 Martinez Concrete, Inc. $95,209.30 SECTION 2. With reference to the determination of"Lowest Responsible Bidder", the Rosemead Redevelopment Agency fmds, determines, and declares: A. The Instructions to Bidders provide that "The Awarding Body [the Redevelopment Agency] shall be, and is hereby constituted, the exclusive judge as to the responsibility of a bidder, and in ascertaining the fact that the Awarding Body will take into consideration the business integrity, financial resources, facilities for performing the work, experience in public works generally, and experience in similar public works operations, of the various bidders." B. The Standard Specifications and Special Provisions provide that the "lowest responsible bidder is defined as the lowest bidder whose offer or proposal best responds in quality, adaptability, fitness and capacity to the particular requirements of the proposed work, and whose financial responsibility, reliability and reputation are such as to best insure satisfactory completion of the work. Determination as to which bidder is the Lowest Responsible Bidder will be made by the Redevelopment Agency, and the decision of the Redevelopment Agency will be conclusive as to all bidders." C. The Standard Specifications also provide that the Agency may make "such investigations as it deems necessary to determine the ability of the bidder to perform the work." SECTION 3. The Redevelopment Agency hereby determines that the Lowest Responsible Bidder for 1995-96 and 1996-97 Concrete Repair Project is Martinez Concrete, Inc. The Redevelopment Agency determines that Martinez Concrete, Inc. is the lowest responsible bidder, because the Agency determines that neither Kukbo Construction nor Robinson's Construction is the Lowest Responsible Bidder for the project. This determination is made for this project, 1995-1996 and 1996-1997 Concrete Repair Project only and for no other projects. This determination is based upon the necessity of an experienced and reliable contractor for concrete repair work in various areas of the public right of way. SECTION 4. The Agency determines that Kukbo Construction Group, Inc. is not the Lowest Responsible Bidder for the project for each of the following reasons: The Agency states and declares that each of the following findings, of and by itself, is a separate and distinct reason for the failure of the Council to select Kukbo Construction, Inc. (hereinafter "Kukbo") as the Lowest Responsible Bidder: A. Kukbo did not submit any references as required as part of the bid package; and B. Upon staff inquiry regarding references, Kukbo provided information on three recent projects, none of which included public works; and C. Kukbo has apparently not completed any project similar to the Agency's Concrete Repair Project; and D. Kukbo has no public agency experience and therefore no experience with the "Green Book" Standard Specifications for Public Works Construction. SECTION 5. The Agency determines that James Robinson d.b.a. Robinson's Construction is not the Lowest Responsible Bidder for the project for each of the following reasons: The Agency states and declares that each of the following findings, of and by itself, is a separate and distinct reason for the failure of the Council to select . Robinson's Construction as the Lowest Responsible Bidder: A. Robinson's Construction submitted three references with its bid. Upon investigation by staff, it appears that the work listed as examples of previous work of Robinson's Construction was in fact performed by other entities; and B. Staff contacted the Robert Bridges, at the contact phone number listed in the bid proposal. Although Mr. Bridges did not initially respond to staff's voice mail message, on February 18, 1997 he provided supplemental information including a cover letter which states "Robinson's Construction has been in the construction industry for over ten years, he does have references on residential projects which he has been working on although his references aren't that great in the public work sector." C: Staff has been unable to verify any public works experience and demonstrated familiarity with the requirements of the "Green Book. 2 SECTION 6. The next lowest bidder, Martinez Concrete, Inc. submitted an incorrect contractor's license number on its bid form. The license number supplied was the individual license number of the Mr. T. Roberto Martinez. This license was utilized by Mr. Martinez prior to the incorporation of Martinez Concrete, Inc. It is clear from the bid submittal form that the intended contractor was "Martinez Concrete, Inc." Staff's previous recommendation to disqualify Martinez Concrete Inc. was based upon the erroneous license number supplied. Staff has withdrawn that recommendation and now recommends that the Agency adopt this Resolution awarding the bid to Martinez Concrete, Inc. SECTION 7. Martinez Concrete, Inc. has a valid contractor's license and verified public agency experience in similar jobs. SECTION 8. The Redevelopment Agency hereby awards the bid for the 1995-96 and 1996-97 Concrete Repair Project to Martinez Concrete, Inc. in the amount of$95,209.20. SECTION 9. The Agency Secretary shall certify to the adoption of this Resolution. PASSED, APPROVED and ADOPTED by the Rosemead Redevelopment Agency on this 25th day of February, 1997.
