REHAB - Aproval of Minutes 01-28-97 NOT OFFICIAL UNTIL APPROVED BY THE ROSEMEAD REHABILITATION APPEALS BOARD MINUTES OF THE REGULAR MEETING ROSEMEAD BUILDING REHABILITATION APPEALS BOARD JANUARY 28, 1997 The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order by Chairman Clark at 7:03 p.m. in the Conference Room of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Boardmember Taylor. The Invocation was delivered by Boardmember Vasquez ROLL CALL OF OFFICERS: Present: Boardmembers Bruesch, Taylor, Vasquez, Vice-Chairman Imperial, and Chairman Clark Absent: None APPROVAL OF MINUTES: OCTOBER 22, 1996 -REGULAR MEETING MOTION BY BOARDMEMBER TAYLOR, SECOND BY BOARDMEMBER BRUESCH that the Regular Minutes of October 22, 1996 be approved as submitted. APPROVAL OF MINUTES:NOVEMBER 26, 1996 -REGULAR MEETING MOTION BY BOARDMEMBER TAYLOR, SECOND BY VICE-CHAIRMAN IMPERIAL that the Regular Minutes of November 26, 1996, be approved as submitted. Vote resulted: Aye: Bruesch, Vasquez, Clark, Imperial, Taylor No: None Absent: None Abstain: None The Chairman declared said motion duly carried and so ordered. I. ADMINISTRATION OF OATH The.Board Secretary administered the oath to all persons wishing to address the Board. II. HEARINGS A. 3047 BARTLETT AVENUE The subject property consists of an owner-occupied single family residence and a vacant second unit. The property is zoned R-1. A"Please Letter" was mailed to the property owner on June 24, and a "bulky item" trash notice was sent on July 9, 1996. Inspection on July 24, 1996 REHAB 01-28-97 Page#1 revealed only minor yard area cleanup. The Building Official declared the property substandard and filed a Declaration of Substandard with the Los Angeles County Recorder's office. A "Thirty Day" certified letter was mailed and posted on the property on August 2, 1996, requesting abatement of the substandard conditions. The letter was returned "unclaimed" and was sent again by first class mail. On August 14, 1996, the property owner,Mrs. Ballestero, sent a written request for a public hearing. She explained that it was her intention to demolish the vacant front. house, but due to financial constraints, would be unable to do so until January 1997. On October 2, 1996 another "bulky item" trash notice was sent. An inspection on October 8, 1996 revealed completion of the yard cleanup. At that time, contact was made with the owner's son and the remaining items on the list of defects were discussed. This case had been scheduled for hearing before the Board on November 26, 1996. However, on the day of the hearing, the owner phoned and submitted a written request to reschedule the hearing due to an emergency illness. Inspections on November 26, 1996 and January 2, 1997 revealed no further progress. A Notice of.Hearing was mailed and posted on the property on January 13, 1997. All interested parties have been notified. The City Building Official recommends that the Board find the property substandard and order all substandard conditions removed,and/or corrected by March 3, 1997. However, if permits and approvals are obtained and sufficient progress is achieved by March 3, 1997, the abatement date may be extended to April 1, 1997. Those present were:Natalie Ballestero, 3047 Bartlett Avenue,Rosemead;Irene Prieda, 806 Cinnamon Lane,Duarte; and Ray Ballestero, 3047 Bartlett avenue,Rosemead. Ms. Ballestero stated that she does not want to invest more money into the front property as it is deteriorated and plans to demolish the structure. Boardmember Taylor asked when the demolition could take place. Ms.Ballestero requested as much time as possible and she is currently working, but will retire in May or June and can devote more time to this project then. MOTION BY VICE-CHAIRMAN IMPERIAL„ SECOND BY BOARDMEMBER VASQUEZ that the Board find the property substandard and order all substandard conditions removed and/or corrected, order property to be maintained and closed to unlawful entry, exterior areas be maintained and work be completed by June 1, 1997. B. 3447-3449 BARTLETT AVENUE The subject property consists of two vacant single family residences located in the R-1 zone. A"Please Letter" was mailed to the property owner on June 24, and a "bulky item" trash notice was sent to both the owner and tenants on July 9, 1996. Inspection on July 25, 1996 revealed no progress The Building Official declared the property substandard and filed a Declaration of Substandard with the Los Angeles County Recorder's office. A"Thirty Day" certified letter was mailed and posted on the property on August 7, 1996, requesting abatement of the substandard conditions. On August 20, 1996, contact was made with Mr. Serna, the property owner, and access was gained to the rear of the property. Additional violations were noted and a revised list of defects was sent to the owner. On September 5, 1996, the tenant at 3449 Bartlett Avenue phoned and advised,Building Department staff that'he had rented a bin and,would be cleaning the property. A follow-up inspection was attempted on September 10, 1996, however, REHAB 01-28-97 Page#2 the yard gates were locked. On October 2, 1996, another "bulky item" trash notice was sent. Inspections were attempted again on October 11, and November 12, 1996, but the gates remained locked. Telephone contact was made with Mr. Serna and he advised staff that the tenant at 3449 Bartlett.Avenue would vacate by November 15, 1996, and that he would call back to arrange for inspection. No reply was received, and on December 12, 1996 and January 2, 1997, inspections were again attempted. The inspector could not enter the property because of the locked gates, but there was no visible improvement observed. A Notice of Hearing was mailed and posted on the property on January 13, 1997. All interested parties have been notified. The City Building Official recommends that the Board find the property substandard and order all substandard conditions removed and/or corrected by March 3, 1997. However,if permits and approval are obtained, and sufficient progress is achieved by March 3, 1997, the abatement date may be extended to April 1, 1997. Omar Serna, 3444 Burton.Avenue,Rosemead, property owner, was present, and stated that the majority of the property in the rear has been cleaned up and is being painted and that he continues to work on the property. MOTION BY BOARDMEMBER IMPERIAL, SECOND BY BOARDMEMBER VASQUEZ that the Board approve the Building Official's recommendation. C. 8820 GRAND AVENUE The subject property consists of a tenant-occupied single family dwelling located in the R- 1 zone. A "Please Letter" was mailed to the property owner on June 9, 1996. Inspection on July 27, 1996. revealed no progress. The Building Official declared the property substandard and filed a Declaration of Substandard with the Los Angeles County Recorder's office. A"Thirty Day" certified letter was mailed and posted on the property on August 9, 1996, requesting abatement of the substandard conditions. On August 12, 1996, the property owner,Mr. Quinones, came to City Hall and advised Building Department staff that he was having trouble evicting the tenants. Mr. Quinones contacted staff again on September 10, 1996 to report the tenant would be vacating soon, and that all items on the list of defects would be corrected. Follow-up inspections in October,November,,and December revealed no progress. Additional"bulky item" trash notices were sent on October 2, 1996 and January 7, 1997. A Notice of Hearing was mailed and posted on the property on January 13, 1997. All interested parties have been notified. It is recommended that the Board find the property substandard and order all substandard conditions removed and/or correct by March 3, 1997. However, if permits and approvals are obtained and sufficient progress is achieved by March 3, 1997,the abatement date may be extended to April 1, 1997. Georgia Alvera, 158 Junipero Serra, San Gabriel, property owner, was present. Chairman Clark asked Ms. Alvera if she was aware that this week is the "bulky item" trash pick up week. • REHAB 01-28-97 Page#3 Ms. Alvera responded that she was not as she resides in San Gabriel and continued that they were hampered by a tenant living there. The tenant has now moved out and they can proceed with the clean up and will then sell the property. Anthony Quinones, 158 Juniper Serra, San Gabriel,, son of Ms. Alvera, responded that he will help with the clean up. MOTION BY BOARDMEMBER IMPERIAL, SECOND BY BOARDMEMBER BRUESCH, that the Board approve the Building Official's recommendation. CITY PROSECUTING ATTORNEY REFERRAL UPDATE No action required on this item. IV. MATTERS FROM OFFICIALS Boardmember Imperial inquired about the status of 4623 Earle Avenue. James Guerra, Building Official, responded that no action has transpired since the property was cleaned in June 1996; however, a Bench Warrant is still out for the owner. V.
