4. PUBLIC HEARING
A. Continued Public Hearing on Specific Plan Amendment 21-01 and Zone Change
21-01 (Prospect Villa)
On March 22, 2022, the City Council continued the public hearing on Specific Plan
Amendment 21-01 and Zone Change 21-01, to the next scheduled City Council
Meeting of April 12, 2022, in order address public comments that were received the
night of the meeting.
Del Mar Property, LLC has submitted entitlement applications requesting to amend
the Zoning Map by changing the zone of 7539 & 7545 Garvey Avenue (APN Nos.
5286-022-009 and 5286-022-010) from Garvey Avenue Specific Plan (GSP) to
Garvey Avenue Specific Plan, Incentivized Mixed -Use (GSP-MU) zone, for the
development of a new residential/commercial mixed-use development. The project
proposes the construction of a seven -story mixed-use development with 6,346 square
feet of nonresidential (commercial) use on the first floor and 75 residential units on
the first through seventh floors. Of the 75 residential units, 30 are live/work units and
45 are residential apartments. The project also proposes 147 parking spaces and
12,547 square feet of landscaping. The project also includes atext amendment to the
Garvey Avenue Specific Plan permitting sit-down restaurants with a minimum
requirement of 1,000 square feet to obtain an Administrative Use Permit (AUP)
for beer/wine sales in the Garvey Avenue Specific Plan (GSP) and Garvey Avenue
Specific Plan, Incentivized Mixed -Use (GSP-MU) zones.
Recommendation: That the City Council take the following actions:
1. Conduct a public hearing and receive public testimony;
2. Introduce the first reading, by title only, Ordinance No. 1008, approving Specific
Plan Amendment 21-01 and Zone Change 21-01; and
3. Adopt City Council Resolution No. 2022-18, entitled:

C. Second Reading and Adoption of Ordinance No. 1009 - Amending Sections
17.28.030(C)(4) and 17.30.040(E) of Title 17 (Zoning) of the Rosemead Municipal
Code
On March 22, 2022, the City Council introduced for first reading Ordinance
No. 1009, which amends Title 17 ("Zoning") of the Rosemead Municipal Code by
amending Sections 17.28.030(C)(4) and 17.30.040(E) permitting sit-down
restaurants with a minimum requirement of 1,000 square feet to obtain an
Administrative Use Permit ("AUP") for beer/wine sales in the Neighborhood
Commercial (C-1), Medium Commercial (C-3), Regional Commercial (C-4), Central
Business District (CBD), and Residential/Commercial Mixed -Use Development
Overlay (RC-MUDO) zones, in place of a Conditional Use Permit ("CUP").
Recommendation: That the City Council approve the second reading and adopt

D. Proposed 2022 State and Federal Legislative Platform
In recent years, the City implemented a Legislative Platform ("Platform") to provide
a streamlined process for responding to legislative proposals that may impact the
City. The proposed Platform identifies the fundamental legislative issues deemed
critical to the City and, upon Council approval, would allow staff to efficiently
respond to legislative items.
Recommendation: That the City Council adopt the proposed 2022 State and Federal
Legislative Platform.
E. 2021 General Plan and Housing Element Annual Progress Reports
California Government Code § 65400 requires the filing of both a General Plan and
Housing Element Annual Progress Report (APRs) by April 1' of each year, for the
prior calendar year, with the State Office of Planning and Research (OPR) and the
Department of Housing and Community Development (HCD). On March 31, 2022,
City staff filed both APRs with OPR and HCD. In order to comply with state law, the
APRs must be presented in a public meeting where the public may provide oral
testimony and written comments. OPR does not require that the APRs be approved
by the local legislative body or receive public comment prior to the annual April 1'
submittal deadline, and revised APRs may be resubmitted at any time.
The General Plan Annual Progress Report summarizes the status of the City's
General Plan and progress in its implementation. The Housing Element Annual
Progress Report summarizes low- to above moderate -income residential building
activity; Regional Housing Needs Allocation (RHNA) progress; and progress of the
housing program implementation for the 2021 calendar year. The Housing Element
Annual Progress Report was prepared on forms provided by HCD, using definitions
adopted by HCD.

Recommendation: That the City Council take the following actions:
1. Receive and file the 2021 Annual Progress Reports; and
2. Direct the Community Development Department to resubmit the 2021 Annual
Progress Reports to Office of Planning and Research and Housing and
Community Development, if there are any modifications.
F. Consideration of Expanding the Flock Falcon Camera Coverage Within the City
The City utilizes the Flock Falcon Cameras at various street locations to assist the
Sheriff's Department in crime prevention and law enforcement measures. Staff is
requesting City Council approval to add ten (10) additional cameras to enhance the
service and fill in coverage gaps.
Recommendation: That the City Council authorize the City Manager to execute an
Additional Services Agreement with Flock Group Inc. for ten (10) Flock Falcon
Cameras at a cost of $28,000 for the first year and $25,000 annually thereafter.
6. MATTERS FROM CITY MANAGER & STAFF
A. Discussion on City's Graffiti Removal Program
The City Council has expressed interest in discussing the City's current graffiti
removal program and how the program can be improved. Currently, all graffiti on
City properties and gang -related graffiti or profanity text/symbols visible to the
public on private property are removed by Public Works staff. For non -gang -related
graffiti on private property, the property owner is responsible for the removal. For
the City to remove all graffiti (gang and non -gang -related) on private property, the
City would need to add one Public Works staff, purchase an additional graffiti
removal truck and necessary materials/equipment; or contract with a graffiti removal
service provider at an annual rate of approximately $168,000. It is recommended that
the City Council further discuss the City's graffiti removal program and the
information provided in this staff report.

B. COVID-19 Update
This is a recurring item that will be on the agenda to update the City Council on items
related to COVID-19.
Recommendation: That the City Council discuss and provide further direction.

7. MATTERS FROM MAYOR & CITY COUNCIL
A. Possible Opposition to Assembly Bill 1771 (Ward) — The California Housing
Speculation Act
Mayor Pro Tem Sean Dang requested the City Council discuss and provide direction
regarding Assembly Bill (AB) 1771, authored by Assembly Member Christopher
M. Ward.
Recommendation: That the City Council discuss and provide further direction to
staff, including submitting an objection letter to the Legislature on the said bill.
B. Establishment of a Public Safety Commission
At the request of the City Council, staff was directed to prepare an ordinance to
establish a new Public Safety Commission that would serve in an advisory capacity
to the City Council and would remain consistent with the other current City
Commission formats.
Recommendation: That the City Council take the following actions:
1. Introduce for first reading, by title only, Ordinance No. 1010, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, ADDING CHAPTER 2.35 TO
TITLE 2 OF THE ROSEMEAD MUNICIPAL CODE AND
PROVIDING FOR THE ESTABLISHMENT OF A PUBLIC
SAFETY COMMISSION FOR THE CITY OF ROSEMEAD; and
2. Approve Resolution No. 2022-24, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY

C. Discussion and Possible Support of the League of California Cities Proposed
Budget Request to the State for Local Assistance for Organic Waste Recycling
Program Development and Implementation
This item is presented to the City Council at the request of Council Member Margaret
Clark to discuss the League of California Cities' (Cal Cities) budget request to the
State to appropriate $180 million (General Fund) for local assistance to continue
helping cities develop and implement organic waste recycling programs as mandated
by Senate Bill (SB) 1383.
