STAFF RECOMMENDATION That the City Council approve the second reading and adopt Ordinance No. 1010 by title only, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ADDING CHAPTER 2.35 TO TITLE 2 OF THE ROSEMEAD MUNICIPAL CODE AND PROVIDING FOR THE ESTABLISHMENT OF A PUBLIC SAFETY COMMISSION FOR THE CITY OF ROSEMEAD STRATEGIC PLAN IMPACT This item is consistent with the City's 2030 Strategic Plan Goal A — Safety, which focuses on enhancing public safety by providing safe access to public facilities, expand neighborhood safety programs, and improve quality of life, which will include assisting homeless residents in our community. The Public Safety Commission is hereby created to facilitate a citizen -based, community effort to organize, promote, advocate, and participate in public safety efforts concerning matters relating to public safety, including understanding police and fire operations, crime prevention, and emergency preparedness to enhance public safety and improve the quality of life in Rosemead. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD HEREBY ORDAINS AS FOLLOWS: SECTION 1. Municipal code amendments; the following sections are hereby added to Title 2, Chapter 2.35 of the Rosemead Municipal Code to read in its entirety as follows: Sections: 2.35.010 — Establishment. 2.3 5.020 — Members. 2.35.030 — Absence from meetings. 2.35.040 — Term. 2.35.050 —Removal from office. 2.35.060 — Regular Public Safety Commission meetings. 2.35.070 — Duties. 2.35.010 — Established. Hereby established an advisory Public Safety Commission with membership, powers and duties as provided herein. 2.35.020 — Members The Public Safety Commission shall consist of five voting members appointed by the City Council, comprised of three residents and two members of our business community, and in addition thereto the following ex -officio members who shall be non-voting members: The City Manager, or his or her designee; 2.35.030 — Absence from meetings If a member of the Public Safety Commission shall be absent from three consecutive regular meetings of the Commission without cause, the office of such member shall be deemed to be vacant, and the term of such member ipso facto terminated. 2.35.040 — Term Each member of the Public Safety Commission shall have a term of office of two years which shall be staggered so that three residential members shall be appointed in the odd -numbered years and two business community members shall be appointed in even -numbered years. Terms shall commence on July 1 and expire on June 30 of the appropriate calendar year, unless a lesser term is necessary to fill a vacancy. Should any vacancy exist on the Commission, otherwise than by expiration of term, such vacancy shall be filled by appointment for the unexpired portion of the term. At the formation of the Public Safety Commission in the Year 2022, the three residential members shall serve an initial one-year term to coincide with the odd -number year appointment schedule as stated above. 2.35.050 — Removal from office Notwithstanding the provisions of Section 2.35.040, all members of the Public Safety Commission shall serve at the will of the City Council. 2.35.060 — Regular Public Safety Commission Meetings Regular meetings of the Public Safety Commission shall be on the fourth Thursday of each month at the hour of seven p.m. or if such date falls on a holiday on the next succeeding day which is not a holiday. 2.33.070 — Duties A. Serve in an advisory capacity to the City Council and staff on public safety efforts; B. To advise on other related items as assigned by the City Council. C. Receive and review crime incidents and trends provided by LASD and Public Safety Department for recommendation to the City Council; D. Receive and review staff recommendations on emergency preparedness (e.g., earthquake, heatwaves, any additional emergency preparedness) information for recommendation to the City Council; E. Participate in the efforts of the Community Academy; F. Receive and provide homeless encampment issues for recommendation to the City Council; G. Receive and provide crime prevention and public awareness programs and events for recommendation to the City Council; H. Make recommendations to the City Council regarding policies and services related to public safety; and I. Provide the City Council with a Year -End Review Recommendation Report. SECTION 2. Severability. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 3. Publication. The City Clerk is directed to certify this ordinance and cause it to be published in the manner required by law. SECTION 4. Effective Date. DISCUSSION On March 22, 2022, the City Council discussed the establishment of a Public Safety Commission to facilitate a citizen -based, community effort to organize, promote, advocate, and participate in public safety efforts concerning matters relating to public safety, understanding police and fire operations, crime prevention, emergency preparedness, and any other issues which may be assigned by the City Council. As a Commission, the advisory board will begin its efforts to help improve the safety and overall welfare of our residents and business community in partnership with City staff and Temple Sheriff Station Deputies. In addition, the Commission will assist in achieving Rosemead's 2030 Strategic Plan goal to "Enhance public safety in our City byproviding safe access to public facilities, expand neighborhood safety programs, and improve quality of life. " After the City Council's approval, the City Clerk's Office will promote and begin to accept applications. STAFF RECOMMENDATION Staff recommends that the City Council: 1. Introduce for first reading, by title only, Ordinance No. 1010 (Attachment A), entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ADDING CHAPTER 2.35 TO TITLE 2 OF THE ROSEMEAD MUNICIPAL CODE AND PROVIDING FOR THE ESTABLISHMENT OF A PUBLIC SAFETY COMMISSION FOR THE CITY OF ROSEMEAD AGENDA 7.11 City Council Meeting April 12, 2022 Page 2 of 2 2. Approve Resolution No. 2022-24, establishing compensation for members of the Public Safety Commission. FISCAL IMPACT To remain consistent with the Beautification, Parks, Planning, and Traffic Commissions, compensation for Public Safety Commissioners will be set at $100 per meeting attended as outlined in Resolution No. 2022-24 (Attachment B). Staff will include the projected amounts into the Fiscal Year 2022-23 budget. Polly Low, Mayor APPROVED AS TO FORM: ATTEST: Rachel Richman, City Attorney Ericka Hernandez, City Clerk Attachment B Resolution No. 2022-24 RESOLUTION NO. 2022-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CITY OF ROSEMEAD, CALIFORNIA, ESTABLISHING COMPENSATION FOR MEMBERS OF THE PUBLIC SAFETY COMMISSION WHEREAS, the Rosemead City Council recognizes the duties given to the Public Safety Commission; and WHEREAS, the Rosemead City Council believes that in addition to recognition, the members of the Public Safety Commission should receive compensation to assist in part for the numerous hours of service they provide to the City of Rosemead, and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That each member of the Public Safety Commission shall receive the sum of $100 for each regularly scheduled meeting and special meeting held and attended. SECTION 2. The foregoing compensation will become effective May 1, 2022. SECTION 3. The City Clerk shall certify to the approval and adoption of this resolution and shall cause this resolution to become in full effect immediately upon passage.
