CC - Item 5G - Adopt Resolution No 2022-36 Approving SB 1 Project List For FY 22-23 Under the Road Repair and Accountability Act of 2017ROSEMEAD CITY COUNCIL STAFF REPORT TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM: BEN KIM, CITY MANAGER 5/A— DATE: JUNE 14, 2022 SUBJECT: ADOPT RESOLUTION NO. 2022-36 APPROVING SBl PROJECT LIST FOR FY 22-23 UNDER THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 (SBI BEALL) SUMMARY On April 28, 2017, the Governor signed Senate Bill (SB) 1 (Beal, Chapter 5, Statute 2017), also known as the Road Repair and Accountability Act of 2017 to address basic road maintenance, rehabilitation, and critical safety needs on both the state highway and local streets and road system. Beginning November 1, 2017, the State Controller will deposit various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new RMRA funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032 (h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and road systems. Prior to receiving an allotment of RMRA funds from the State Controller each fiscal year, the City must submit a proposed project list to be funded with the estimated revenue allocations to the California Transportation Commission. The project list shall be pursuant to a City Council adopted resolution. The Road Repair and Accountability Act of 2017 (SBI Beall) is a significant investment in California's transportation systems of about $5.2 billion per year. The Act increases per gallon fuel excise taxes, diesel fuel sales taxes, vehicle registration taxes, and provides for inflationary adjustments to rates in future years. The Act more than double local streets and road funds allocated through the Highway Users Tax Account, allocating funds from new taxes to a new Road Maintenance and Rehabilitation Account (RMRA). Pursuant to Streets and Highways Code Section 2030, RMRA local streets and roads allocations must be used for projects "that include, but are not limited to," the following: • Road maintenance and rehabilitation • Safety projects • Railroad grade separations • Traffic control devices AGENDA ITEM 5.G City Council Meeting June 14, 2022 Page 2 of 3 • Complete street components, "including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and storm -water capture projects in conjunction with any other allowable project." Maintenance of Effort: RMRA The Road Repair and Accountability Act contains a local agency maintenance of effort (MOE) requirement that applies to funds allocated through the RMRA. The Act states that the MOE requirement is to ensure that these new road funds do not supplant existing levels of city and county general revenue spending on streets and roads. The MOE for the receipt of RMRA funds state that a city or county must maintain general fund spending for street, road, and highway purposes at no less than the average of three years. In making this calculation an agency may exclude one-time funds. A city or county that fails to comply in a particular year may make it up with additional expenditures in the following year. The Act provides that the State Controller may perform audits to ensure compliance with these MOE rules. If the State Controller determines that a city or county has not met its MOE, the agency will be required to reimburse the state for the funds it received during that fiscal year. However, a city or county that fails to comply in a particular fiscal year may expend during that fiscal year and the following fiscal year a total amount that is sufficient to comply. Any funds withheld or returned as a result of a failure to comply will be reapportioned to the other counties and cities whose expenditures are in compliance. Spending Plans and Reports: RMRA The Road Repair and Accountability Act stipulates that prior to receiving RMRA funds in a fiscal year, a city or county must submit to the California Transportation Commission (CTC) a project list pursuant to an adopted resolution. The list must include for each project: description, location, schedule, useful life. [Streets and Highways Code Sec 2034(a)] The Road Repair and Accountability Act also requires that a city or county submit to the CTC an annual report of project completion in order to receive RMRA funds. The report must include descriptions of all projects for which RMRA funds were expended including: description, location, funds expended, completion date, estimated useful life of the project. The City of Rosemead allocation for FY 2022-23 is estimated to be $1,200,854 based on revenue projections. Additionally, there is prior year SBI unallocated revenue in the amount of $342,000 that is available to appropriate towards new projects. Staff is requesting to fund the following projects listed below: Various Residential Resurfacing Project: Roadway rehabilitation (asphalt coldmill & overlay) on multiple residential street segments within Quadrant 2. • Citywide Arterial Street Improvements Project: Roadway reconstruction and rehabilitation (asphalt cold -mill & overlay) on Del Mar Avenue, Jackson Avenue, New Avenue, Lower Azusa Rd, Mission Drive, Temple City Blvd, and San Gabriel Blvd within the City. City Council Meeting June 14, 2022 Page 3 of 3 Furthermore, the following project is carried over from FY 2021-22, and will be completed using the SB 1 funds: Valley Blvd Resurfacing Project (Phase I & II): Asphalt concrete pavement cold mill and overlay, full depth concrete reconstruction, installation of ADA curb ramps and City Entry monuments, replacement of sidewalk, curb and gutter, and restoration of traffic loops, striping, and pavement markings. STAFF RECOMMENDATION It is recommended that the City Council: Approve the adoption of Resolution No. 2022-36 approving list of projects for FY 2022-23 under the Road Repair and Accountability Act of 2017 (SB1 Beall). FINANCIAL IMPACT None. STRATEGIC PLAN IMPACT This item is consistent with the City of Rosemead's Strategic Plan Goal C - Infrastructure and Facilities, which is to enhance streets, sidewalks, and public infrastructure; coordinate with relevant utility agencies regarding safety and enhancements; and modernize facilities by expanding the use of wireless network technology and renewable energy. Director of Public Works Attachment A: Resolution 2022-36 Attachment A Resolution No. 2022-36 RESOLUTION NO. 2022-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2022-23 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 to address the significant multi -modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of our City are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the City of Rosemead must adopt by resolution a list of projects proposed to receive fiscal year funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project's completion, and the estimated useful life of the improvement; and WHEREAS, the City, will receive an estimated $1,200,854 in RMRA funding in Fiscal Year 2022-23 from SB 1; and WHEREAS, the City, has revenue received in a prior year totaling an estimated $342,000 in RMRA funding from Fiscal Year 2021-22 from SB 1; and WHEREAS, this is the sixth year in which the City is receiving SB 1 funding and will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and WHEREAS, the City has undergone a robust public process to ensure public input into our community's transportation priorities/the project list; and WHEREAS, the City used a Pavement Management System and engineering assessment of existing conditions to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the communities priorities for transportation investment; and WHEREAS, the funding from SB 1 will help the City maintain and rehabilitate streets and roads throughout the City this year and similar projects into the future; and WHEREAS, the 2020 California Statewide Local Streets and Roads Needs Assessment found that the City streets and roads are in an "at -risk" condition and this revenue will help us increase the overall quality of our road system and over the next decade will bring our streets and roads into an "Excellent" condition; and WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have an immediate impact on our constituents increasing access and mobility options for the traveling public. THE ROSEMEAD CITY COUNCIL HEREBY RESOLVES AS FOLLOWS: SECTION 1. The foregoing recitals are true and correct. SECTION 2. The following list of newly proposed projects will be funded in -part or solely with Fiscal Year 2022-23 Road Maintenance and Rehabilitation Account revenues: Project Title: Various Residential Street Resurfacing Project Description: Cold milling and asphalt pavement, construction of rubberized asphalt overlay. Project Location: Quadrant 2 Estimated Project Schedule: Start (09/2022) — Completion (06/2023) based on the component being funded with RMRA funds Estimated Project Useful Life: 10-15 Years Project Title: Citywide Arterial Street Improvements Project Description: Asphalt concrete pavement cold mill and overlay, full depth concrete reconstruction, installation of ADA curb ramps, replacement of sidewalk, curb and gutter, and restoration of traffic loops, striping, and pavement markings Project Location: San Gabriel Blvd, Temple City Blvd, New Ave, Lower Azusa Rd, Jackson Ave, Del Mar Ave, Mission Dr Estimated Project Schedule: Start (09/2022) - Completion (06/2023) based on the component being funded with RMRA funds Estimated Project Useful Life: 10-15 Years SECTION 3. The following previously proposed and adopted projects may also utilize Fiscal Year 2022-23 Road Maintenance and Rehabilitation Account revenues in their delivery.
