CC - Item 5B - 960 Hour Rule for Bill OrnelasS E M 6 • Nr~ftAOgATEO ~0~i0 ROSEMEAD CITY COUNCIL STAFF REPORT TO: THE HONORABLE-MAYOR AND CITY COUNCIL FROM: OLIVER CHI, CITY:MANAGERg(,L~- DATE: JANUARY 22, 2008 I SUBJECT: CALPERS WAIVER OF 960-HOUR RULE FOR BILL ORNELAS I SUMMARY Public Employee Retirement Law prohibits a retired annuitant from working more than 960 hours in a fiscal year unless a resolution is adopted in accordance with Government Code section 21224(h). Bill Ornelas, a retired CalPERS annuitant has been working for the City for approximately seven months and is close to his hour limit. Staff is currently working on a permanent plan for his position and the graffiti abatement/community services function, and will be ready to move forward by July 1, 2008. Staff Recommendation Staff recommends that the City Council adopt Resolution 2008-09 (Attached) requesting an employment extension per Government Code section 21221(h). WHEREAS, William Ornelas retired from the City of Duarte in the position of Field Services Manager, effective November 18, 2005; and . WHEREAS, the City of Rosemead appointed William Ornelas to the position of Interim Senior Graffiti Abatement Manager, a position deemed to be of limited duration and requiring specialized skills, effective July 1, 2007; and WHEREAS, William Ornelas is expected to reach his maximum of 960 hours this fiscal year on or about January 31, 2008; and WHEREAS, due to the appointment of a new City Manager and the subsequent reorganization of the several departments and key positions the recruitment for this position has been postponed pending the appointment of a permanent Director; and WHEREAS, William Ornelas has extensive experience in graffiti abatement, staff training and community service; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD HEREBY RESOLVES AS FOLLOWS: That the CalPERS Board of Administration be requested to approve an extension in accordance with Government Code section 21221(h) for the temporary employment of William Ornelas for 800 additional hours or through June 30, 2008. An appointment made under this section of this subdivision may not exceed a total of 12 months. PASSED, APPROVED AND ADOPTED this 22nd day of January 2008.
